If we want to be very precise, unauthorized immigrants aren't committing any crimes just by being here (if they haven't previously been deported). Crossing the border illegally is a crime, but merely being here without authorization is only a civil infraction. In fact, the majority of unauthorized immigration comes from visa overstays (usually a civil infraction) rather than illegal entry (a crime).
Yep, and most traffic law violations are “only civil infractions”, however driving without a license is a criminal infraction. My point was that we do not limit police to enforcing only criminal infractions.
