Exactly. If you hate whites and make it a point to attack every white person you see, that's pre-meditated. You deserve a harsher penalty than someone who gets into a fight and accidently kills a person.

I don't like "Hate crime" legislation as a general rule. A crime is a crime is a crime. However, here is a case that common sense says "Yeah, race mattered here". Sad really this requires "investigation"

Motive is always relevant in a crime - it's the difference between Murder 1 and Murder 2, so it's not anymore speculation than goes into any other case - the prosecution has to prove it beyond a reasonable doubt. For your second point: a hate crime has more potential and actual societal effects than a non-hate crime, therefore non-hate crimes and hate crimes are hardly the same thing.This sort of crap happens a dozen times a day, all over the country. I doubt race had anything to do with it, beyond 4 punks looking for a victim using it to intimidate 1 guy alone, looking to be victimized.
I am not a fan of hate-legislation. Murder, mayhem, rape, all are hate crimes and have nothing to do with race per se. Punishments should be based on the crime, not on some fatalistic speculation of what the criminal's motive might be. It's crazy. The motive is "I hate you because you rejected my advances, die bitch" and the guy gets a lighter sentence than if the motive is "I hate you because you're white, die bitch." That's absolutely nuts.

The guy appears to be a Goth, and was possibly dressed funny and had silly piercings. I bet that was part of the motivation for the attack.
