How to deny a cop demanding ID for no reason

I agree he is a jerk about it but he also stands up for his rights... and that is a good thing. I would argue that a cop that lies and tries to violate your rights is an even bigger asshole though.
 
It would be nice if they trained police more on when they can and can't demand ID.
That would help.

They teach them how to intimidate to get the info they want without technically breaking the law. This creates an adversarial relationship between cops and the public.

All you have to do is accept the risk of the LOE taking you to jail. Your rights protect you after you're in the system, not before.

So you think that lots of people have an attorney or can afford one?

You also realize that without camera footage a person is basically ****ed... it is their word vs the cop and that means losing.

Think back to your high school reunions. The guys that became cops were all the assholes you dealt with.

That cop had no reason to ask for ID.

In America, everybody gets an attorney. Thanks for buttressing my point. Rights are protected once in the system. They may not be until then.

You said "your attorney"... not some barely competent public defender that will plea deal 90% (or whatever it is) of their cases.

EDIT: I low balled it to be on the safe side but I was not even close.

In the United States, roughly 97% of federal cases and 94% of state cases are settled by plea bargaining (Goode, 2012).

They should not have arrested you in the first place.

What if you lose your job because you're illegally in custody?

Knowing basic law should already be part of their training.
 
Know the law of your jurisdiction. No need to be confrontational. 'You have been advised by your union/dad/lawyer/lawyer sister etc. that you are cooperating but do not consent to any interviews or searches without your union/dad/lawyer/lawyer sister being present.' Do not raise your voice and do not change your language. If you already have your phone out keep it on, at least the audio part so it can clearly hear you.
 
The above worked with my boy when sheriff sniffed around him and his car at the local teenage park and kiss.

You can refuse to show ID. The cop can either walk away, or keep harassing you. You can then walk away, and if the cop arrests you, just let him and deal with it later. File a lawsuit, and they will pay you a little money to drop it.

Unless you have committed a felony in most states, that arrest is illegal.

It'd be nice if there was some kind of standard of training that police officers had to meet.

But I think it depends on the town or locality and how much time/money they budget for that.
 
Here in Austria, the police may ask for your ID and you must provide it to them to get identified.

If you don't have an ID, they take you to the station and will keep you there until you are IDd.

Unlike in Germany, you don't have to carry an ID around with you in public here in Austria, and locals (= natives) are rarely asked for IDs, mostly just foreigners or foreign-looking people.
