the rules can be changed to something of the following.

the trial will be set in 1 week. We expect to have the articles in 1 week.
if there are no articles presented and no prosecution we will hold the trial without them.

this happens in court cases. the trial will start without the prosecution.

No. they can change the rules. that is what this thread i about. right now it is simply senate rules that say they can't start.
Graham is talking about changing those rules giving the house a deadline to send the articles or they will proceed with a trial
without them.

basically there would be a trial with no prosecution. it is within their pre-view to do so.
you don't know what you are talking about.

actually it is. happens all the time in normal courts. Usually if the prosecution fails to appear the case is dismissed.
there is a date set and the trial happens anyway.

you once again don't know what you are talking about.

I have already posted this. even legal experts agree. impeachment is a process not a vote.
the vote is part 1 of that process. part 2 is delivering the articles to the senate.

It hasn't happened. Trump is still in the oval office, isn't he? So this is like the idiot Dems issuing a letter saying he has to get out by noon Thursday because he has orange hair. It's meaningless, isn't it?

Must they be transmitted to the Senate to trigger a trial, or could they be held back by the House until the Senate decides what the trial will look like, as Speaker Nancy Pelosi has hinted?

The Constitution doesn’t say how fast the articles must go to the Senate. Some modest delay is not inconsistent with the Constitution, or how both chambers usually work.

But an indefinite delay would pose a serious problem. Impeachment as contemplated by the Constitution does not consist merely of the vote by the House, but of the process of sending the articles to the Senate for trial. Both parts are necessary to make an impeachment under the Constitution: The House must actually send the articles and send managers to the Senate to prosecute the impeachment. And the Senate must actually hold a trial.

If the House does not communicate its impeachment to the Senate, it hasn’t actually impeached the president. If the articles are not transmitted, Trump could legitimately say that he wasn’t truly impeached at all.

That’s because “impeachment” under the Constitution means the House sending its approved articles of to the Senate, with House managers standing up in the Senate and saying the president is impeached.

well the senate needs to end this obstruction of congress by pelosi.
they need to just change the rules and force her hand.

just like schiffs whole trial was a nothing burger. no evidence no crimes no nothing as testified by multiple witnesses.
