Graham gives Pelosi ultimatum, proposes Senate rule change to remove her from impeachment process

That isn't whats being claimed at all. They are arguing that the Senate can't start a trial until they send the Articles to them. Apparently, according to Mitch McConnell, they are right.
The only way for that to be true is if he isn't offically impeached yet. If he is impeached then its up to the senate how they want to proceed

Pelosi needs to **** or get off the pot. She should pull her 2020 candidates off the campaign trail, or the GOP should shut this farce down and dismiss.

And you have no trouble with the guy who is supposed to promote an impartial assessment of the facts not revealing the process so that Pelosi can name an appropriate team to argue the House’s case, and saying he will coordinate the trial with the defendant. The GOP leadership that is making a farce of this, having announced the verdict before the trial.

I have no idea if the Senate can vote on something passed in the house before its sent to them. Its a very nuianced argument over semantics and it ties into if Trump is impeached yet or not.

As i said earlier, it was a clever of Graham to make this argument. Ultimately if they pursue it and the Democrats challenge it, a court will need to intervene.

Imo, if Trump is officially impeached then its now up to the Senate what comes next. If he isnt offically impeached, the house csn continue to delay it until they next congress is sworn in. That would raise a new question if it goes on that long. I think it would require a new vote at that point.

Yep i saw this coming. They can very much do this and basically they can give her a week to send them over and if not start the trial without a prosecution.
happens in court all the time.
 
Show us all where in the Constitution that it says that there is an established time frame or deadline for forwarding Articles of Impeachment to the Senate.
If you cannot find a specific reference to a deadline, it's because the framers did not include it, and Graham's proposed rule change will be ruled unconstitutional for that very reason.

The President is impeached, and there is nothing that requires Nancy Pelosi to forward the Articles of Impeachment before a specific amount of time has elapsed, therefore any proposed rule change resulting in a Senate procedure would not have any bearing on impeachment whatsoever, because Trump IS impeached NOW....that is a fact.

What this is was a floor rule. There is nothing that says that the floor rule shouldn't be changed in fact i started a thread on this very subject a while ago.

the courts will not get involved in a political process. which is what this is.

If Mcconnell changes the rules it would go something like this.
the senate will give the house 1 week to deliver the articles. if by the end of the week the articles and impeachment managers are not delivered we will proceed
to trial without prosecution.

This will give pelosi a chance to play ball. now if she still does not move on this the senate can hold the trial without prosecution.
which would default to a trump acquittal since there is no one to present evidence against him similar to a real trial.

it actually gets worse from there for democrats.

So basically without the articles of impeachment there and the senate trial beginning without them trump is clear and is actually not impeached.

in fact she really didn't even have support the first time.
if she tries it again she will burn down in flames.

Nope it is the perfect play. Pelosi doesn't have the political capital to try it again.
if she does then she will burn the democratic party to a crisp attempting it.
