German Journalist Given Seven Month Sentence for Meme Mocking Government’s ‘Hatred’ of Free Speech (1 Viewer)

I think the libeled person would have been better advised to not give this scumbag the attention they all so desperately crave, by simply ignoring the whole thing (rather than taking it to court).

Let me put it this way: If someone like @Juin (who resides in Germany as little as I do) called me a Nazi holocaust denying pedophile there, I'd have the option of suing him for libel.

If I did that, the court would decide on the gravity of the libel and pass the sentence it holds to be appropriate.

I wouldn't sue though, seeing how I don't waste my time with people like that or any other.

But if I did, the court is under obligation to take the matter up and decide whatever.

In Germany freedom of expression does not trump the laws on libel.
But these are criminal charges? I’m not against libel laws

If Germany did then David Bendel would not have been facing prosecution for mocking a government minister.
Once again, he's prosecuted for defamation. Specifically, circulating a photo shopped image with the minister holding up something they never said.
Germany cannot both claim such a barbaric law and claim to be a democracy. Ex German Interior Minister Nancy Faesar cannot be protected by the law from mockery
"Barbaric law". The guy isn't going to spend any time and jail and is paying restitution for defamation.
Are you not free to denounce Trump all you want :)?
He wasn't denouncing.

German courts rule, none of us do.
Saudi Arabian courts rule , Iranian courts rule. Are you saying you have no opinion on anything outside your own country

I've said (to you) all I can say (to you) on the matter and am now done.

If you wish to pursue the rather childish ambition of arguing just for argument's sake, you'll have to do that with those more patient than I am.

Bye.

Fine, you won’t give your actual opinion that’s fine.

puleeeeze with the thousands of photo shopped images floating on X? They just wanted to go after the AfD. "show me the man, and I will find you his crime", said Lavrenty Beria; Stalin's hatchet man.

"Barbaric law". The guy isn't going to spend any time and jail and is paying restitution for defamation.

The law, not the sentencing. It is straight from the Inquisition. Then it was blasphemy against God, in today's Germany it is blasphemy against a government minister

Well he calls himself the editor of a paper. Is he? I don't know that much about Nazi's in Germany, you seem to be an expert.

what propaganda? what's not true? Germany is back to it's fascist ways.

Your President is the son of a millionaire running tariffs to pay for tax cuts for his wealthy pals.

We can and do also fire our leaders before their term is done. You have Trump or anyone else for their full term and when they go rogue like Trump has - you can't do anything about it.
absolutely nothing to do with the OP. so,i'll not even bother to answer further

Even if he is an incompetent?

You appear not shocked at all at somebody getting sentenced to 7 months for exercising essentially what is his right to free speech.
free speech ?? not even close - look at this AI search

In Germany, defamation is a criminal offense, punishable by imprisonment or fines, with harsher penalties for public or written defamation. It encompasses malicious gossip, false allegations, insults, and slander, all of which aim to protect an individual's honor and reputation
and this

§ 185 StGB: The Offence of Insult under German Law

insulting another person is considered a so-called offence of defamation of honour and is punishable as such under § 185 StGB.

The insult requires a manifestation of disrespect, disregard, or contempt that can make the person concerned look contemptible. In contrast to an assertion of fact, a personal and defamatory value judgement must somehow have been expressed towards the person concerned or a third party. Factual allegations can, at most, constitute an insult if they are demonstrably untrue, and secondly, they have been expressed personally to the person concerned.

The “statement” can be committed in various ways: For example, it can typically be made by the spoken word or in written form. In addition, an omission can also constitute an insult, as can assault. Such assault, which is a qualification of simple insult, would be, for example, spitting on another person or showing the middle finger. On the other hand, general rudeness, tactlessness or aloofness are not sufficient to be considered insults.

What happened to the "liberal democracies" of Europe?
Germany has been accused of violating basic Western values yet again, as a news editor in Germany faces a hefty fine and a seven month prison sentence for posting a meme mocking the government’s “hatred” of free speech.

The Bamberg district court in Bavaria sentenced Deutschland-Kurier editor David Bendels this week to seven months in prison on probation and a fine of nearly sixty per cent of his annual income, or 210 ‘daily rates’, for posting an image on social media of Interior Minister Nancy Faeser holding an altered sign.

The common meme tactic of changing the words on signs held by politicians for satirical purposes was used to make Faeser’s sign read: “I hate freedom of speech”.

Bendels was initially convicted in November, and the ruling was confirmed on Monday, finding that he had committed “defamation directed against people in political life,” Die Welt reported on Tuesday.According to Bendels, it is the first time in the history of the Federal Republic of Germany that a journalist has been threatened with prison for breaching the statute.
They were never liberal democracy this is Germany doing is standard thing

Germany has been raiding the homes of those it believes to be making offensive statements online. CBS rode along with six armed officers as they raided a suspect’s home and seized his electronics. such laws come as a surprise even to German citizens.

CBS noted that there are 16 units with teams of investigators that monitor hate speech across the country. Laue, who leads the lower-Saxony unit, said that his office alone typically handles about 3,500 cases per year.

Alfonsi summarized that German law "prohibits any speech that could incite hatred or is deemed insulting" and asked the prosecutors about how this works in practice.

I imagine a criminal omission has to be when you omit to address someone by their preferred pronoun :)

When capitalists screech free speech they are saying they should be free to buy up all media outlets to brainwash the masses to their bidding. Trumpists are proving Lenin quite correct.

Exactly. Here's Lenin himself saying pretty much the same thing you are:

The decisive question is who enlightens the people, who educates them? In those countries, it is actually capital that rules; that is, nothing more than a clique of a few hundred men who possess untold wealth and, as a consequence of the peculiar structure of their national life, are more or less independent and free. They say: 'Here we have liberty.' By this they mean, above all, an uncontrolled economy, and by an uncontrolled economy, the freedom not only to acquire capital but to make absolutely free use of it. That means freedom from national control or control by the people both in the acquisition of capital and in its employment. This is really what they mean when they speak of liberty. These capitalists create their own press and then speak of the 'freedom of the press.'

aha. How nice that you tell me. :) - Not that i get fascist without recognizing.

Sorry Dude, this really get´s hillarious. Trump 25 runs full autocratic path and you talk about fascism in Germany?

to all free speech crusaders:

go out and fight for your right to manipulate, hate, lie, insult and all in one beeing the finest asshOle on earth. in America please.

The funny thing is.. all these laws and rules were put in place (directly or indirectly) by the US/UK/France after WW2. Now there is a resurgence of Nazi ideology among East Germans especially, and suddenly the far right in the US is up in arms when these neo-Nazis are put to the law of the land.

Listen, the first thing that goes out the window in a far-right government is freedom of speech. This has happened under Trump, Orban and others.. Now of course the Trumpets will claim that there is freedom of speech in the US, but we all know that there is danger in speaking out against Trump and his policies. From former federal employees being harassed to not talk about the dysfunctional Trump administration, to legal residents being grabbed off street and being deported.. the crime? Being critical of Israel. Or the fact that US media are bending the knee to one degree or another out of fear of what the Trump administration can do. Or the fact that Trump has ordered investigations into ABC and CBS (think it was those 2)...two of the most (and that aint saying much) critical of him, his business and presidency. Fox News and other right wing media outlets are basically government media at this point, and it will only get worse. You think AP being banned from the White House was a fluke? No that was the beginning...

And for the record, I dont like what Germany did here, but I understand why they did it.
