Fox's Napolitano to Trump: First Amendment 'does not regulate Twitter' | TheHill

Fox News legal analyst Andrew Napolitano said Wednesday that President Trump faces an uphill battle with his threat to regulate social media platforms like Twitter.

“The First Amendment, which guarantees the freedom of speech and of the press since it only regulates the government, does not regulate Twitter," the former New Jersey Superior Court judge said on "America's Newsroom."

"Twitter can take down, modify or correct any user it wants, including the president of the United States," Napolitano added.

Trump should read the Constitution.

How in the ever loving **** does such obvious facts need to be told to Republicans and the president?

Just more evidence of why not to vote for them. Because that level of stupid reaches all the way to their top.

I surprised Twitter did not shut Trump down years ago for ToS violations. Then again, they are attention whores like most of America. How could they resist all the free product promotion Trump gives them? Everyone knows what Twitter is now; less so five years ago.

Thirty years of intensive conditioning.

Yes. I need to constantly remind myself that those remaining in the Republican party are mostly Q-anon, turning the frogs gay, Obama born in Kenya, Clinton body count **** for brains morons that have slowly lost the ability to think for themselves. It's terribly sad.

Not sure he can read all that well. Is it on audio book?

Because they don't care about law or the Constitution. At least as to how it hinders them in their political aspirations & expediency.

He has absolute authority, is immune from prosecution, and can adjourn Congress at his leisure, what does the Constitution stand to that?

This is Our Dear Leader.

I hate to flame the fire, but you've got to admit the guy played the game skillfully for what he wanted to do.

I don't know if he'll prevail (in Nov.), but if he does he will have done nothing anyone alive ever thought possible. It's not a good thing. But it's a unique thing. On second thought maybe it's not as much skill, as wanton disregard no other recent White House occupant had contemplated.

Trump has no respect for the Republic or the office of President. The best thing he can do is to create drama, to divide, to fan the flames of hatred. He is the Reality-TV President and he's turning us into the Reality-TV Nation. That's it.

Yep. I've been claiming that for a long time.

Trump ain't winning in November - he's toast.

I've held off saying it and polls will tighten and widen several times before election day, but his handling of the pandemic has been a PR disaster. The man has put on full display that he is a twisted, demented sociopath in a horrific psychological collapse, and there's no commercial that's going to undue that damage.

He's going to lose and then he's going to meltdown and fight to not leave.

I am more disappointed in the blind Trump followers who have helped make our country the laughingstock of the world.

We haven't spoke in awhile, but up until very recently I felt Trump was favored. Now I'm giving it 50-50, with perhaps just a tiny sliver of default to Trump.

Why?

Because by the numbers Biden looks reasonably good, but definitely not decisive where it counts in the battlegrounds. However, my caution & pessimism comes from Biden's unknown abilities in the debates. He could bomb the debates. In fact, I'm almost counting on him having several bad moments.

And any one bad debate moment, if serious enough and it takes-off and resonates, could tip the scale. So for that reason, I believe trump is still very much alive, even if flailing around a bit currently.

i so hope that Twitter bans him. should have happened years ago.

The problem is, Trump sold himself in 2016 as the outsider, drain swamp.

I agree he has played a decent swampy game up until covid.

I not sure Trump has the ability to hit that curve ball

Regardless Trump b.s. voters to get elected and he has proven to be a political game player with absolutely no ethics

Can we cancel the series now and turn off Nick At Nite, and start a new series on one of the adult channels?

They should have before he was elected. Now that he is, I don't think they can. All of his tweets have become part of his official record as POTUS.

The only thing that worries me about this kind of thinking is that it may give D's a false sense of the inevitable.
I mean, I know you'll vote, but maybe others won't, if they think he's going to lose bigly.

Democrats are treating Biden like Republicans treat Trump. His gaffes, mistakes, and moments where he's in the wrong simply don't matter to them. It's not changing anything when he makes offensive remarks about the black vote, or gets caught lying about something.

Just as nothing seems to effect Trump's numbers, nothing seems to effect Biden's. The debates, assuming they happen, will have no effect on the outcome. Trump may not even show-up to them, and if he does let's not forget that his mental state is so bad that you can be guaranteed he'll sound like he's on crack.

Trump is going to lose and will be a complete spectacle.

I think 2016 PTSD largely prevents that.

Anybody looking for an excuse not to vote was always going to find one.

Voter turnout by Democrats has not been an issue since Trump was elected. I believe we all have learned our lesson. (not me, so much as I have never missed a presidential nor "off year" election).

Most of the country wants this jackass gone. They will not miss the opportunity to pull that lever..... It will probably feel so good that you'll want to do it twice.

But, I hear you: don't count the squashed bugs until you squash them....
