You are taking a "response" and trying to turn back time to a point prior to the implementation of these policies/ex-actions and alluding to it as being "planned", as if all these groups knew ahead of time what Donny would specifically do before he took office. Nope. He doesn’t have the power to violate the constitution, or the laws Congress passed. Congress passed the law specifying what documentation is required to be provided. Harvard provided it. DHS asked for information outside of what the law says Harvard has to provide. That requires a warrant. Harvard said as much. Trump then violated the constitution by attempting to revoke the students visas and harvards certification. He can’t do that, and he was slapped down in court. Again. Because he keeps violating the constitution. Why do you support such a lawless, anti American piece of shit?

The government is violating immigration law. Trump doesn’t have the authority to arbitrarily revoke the student visas, nor remove Harvard’s certification.

Assuming DHs actually has that authority government actions can't be arbitrary or capricious. Singling out Harvard because you don't like the fact that they pushed back would seem to be not only arbitrary but down right retaliatory.

Apr 16: Noem gave Harvard 10 business days, until Apr 30, to turn over 8 categories of visa student data.

Note: Even that original request included private disciplinary and misconduct info Harvard couldn’t legally share under FERPA.

Apr 30: Harvard complied with only the required SEVIS data.

May 7: DHS said it was "insufficient," gave 1 more week to hand over the information Harvard couldn't legally share under FERPA.

May 22: DHS revoked certification, gave 72 hours to produce all records, including 5 years of protest videos and every disciplinary file.

Demand grew from 8 items to a sweeping request for information, far beyond what the law requires or allows.

Why is this wrong?

1. "The government must follow the procedures outlined in, 8 C.F.R. 214.4, which require formal notice, a meaningful opportunity to respond, and time for students to transfer or contest their loss of status. Ignoring this process by punishing both the university and its students on 72 hours’ notice is a violation of the fifth amendment."


2. "Without a warrant DHS can lawfully obtain only the narrow SEVIS data set: identity details, address, program/grades, status changes, and disciplinary action tied to a criminal conviction.

Everything else such as non-criminal discipline, non-criminal misconduct, and protest activity falls outside 214.3 and is shielded by FERPA unless DHS brings a valid subpoena or court order.

The Trump admin is once again breaking the law. And Trump supporters are once again defending Trump’s misconduct."

There’s no law that lets DHS force Harvard to cough up the extra protest videos and private files it’s demanding. This heavy-handed push violates the Administrative Procedure Act, due process rights, and the First Amendment. Enforcing immigration rules doesn’t give the executive branch a pass to ignore the Constitution or other statutes. Case closed.

First amendment. If anyone was violent, criminal charges can be brought. But DHS can’t require Harvard provide certain documents without a warrant.

The law is crystal clear on what DHS can ask for. They asked for things outside the law, and Harvard rightfully told them to **** off.

Her letter says nothing. She doesn't reference any laws that Harvard allegedly broke. She demands information but doesn't specify what laws give her the authority to make the demand.

And I would point out that Harvard claims it provided the requested information in any case but Noem found it "insufficient." Not at all clear she can make that determination.

She is simply throwing shit against the wall.
The worst of this is that, when Harvard was willing to provide the requested information, a letter was then sent to Harvard by mistake asking for all the absurd stuff illegally, and because Trump and co. can't issue an apology for the mistake, they go after Harvard like the fascists they are. It's all because they make a mistake and can't apologize.
