But since the president had the power to classify and declassify, if he was charged with mishandling classified information, the DOJ would need to prove that he did not declassify the documents.
Trump wouldn't need to prove that he had.
Not true. No jury is going to accept his defense lawyer simply saying he declassified them. He will have to provide some evidence or testimony to support that claim. Of course, Trump could always testify under oath he declassified them and open himself up to cross examination never mind perjury.

The one's in the garage were actually in a room adjacent to the garage not beside the car. That aside, yes I believe he didn't have the documents. Sloppy and careless but in my view not deliberate .

and besides IF Trump can just declassify documents with out remarking them or letting anybody know it then EVERY other President can just say they did the same thing , lets see Clinton can say he declassified stuff, Obama can say he declassified everything H, Clinton had and everything Biden had
so that would mean there weren't any classified documents any where on Clintons computer and no classified docs at the Biden places
and I am sure the people on the right would be up in arms if that happened without any real proof

all they would have to do is show the documents were never remarked with the date they were suppose to be declassified , what classification they were suppose to have and by who's authority they were declassified.
Trump did not have that done so it is automatically assumed they are still classified seeing there is NO Proof that they were declassified.
the burden to show they were declassified is on Trump
HE can NOT just say he declassified them in his mind and not tell somebody to document the declassification and remark the documents

If you think a jury is simply going to believe it because his lawyer said so AND the prosecution won't challenge it you are dreaming or blowing smoke. I'm going with door number two.

They were (or perhaps it was in a room connected to the garage, reports conflict here), but its a minor detail to them being generally discovered in his house.

Classified documents have not been found in four places, including Biden's garage, a closet, and a so-called think tank. If you think he is truly not aware of the documents in any of those locations, what do you think that says for his cognitive state?

I am all for politicians being held accountable, however we seem to have two tiers of justice. One for democrats and one for republicans. Hillary Clinton should be in prison for how she handled and ultimately attempted to destroy evidence of her handling of such documents and she was given a pass. Trump's Mara Lago estate was jack booted thug raided over simply hesitation of turning documents over to NARA quick enough. Biden has held possession of dcouments he was not as vice president entitled to possess away from the White House after he left office. It will be interesting to see if the Justice Dept treats Biden as Trump has been treated.

However, he needs to refute the prosecution if he wants a jury to acquit him. Agreed he could just rest after the prosecution lays out their case, no doubt in great detail, or just say the President can classify and declassify and hope for the best.

He would have to be indicted first for it to even become an issue. I think Brandon's four document stashes may have taken the steam out of that prospect.

I doubt that especially given the obstruction charges. Never a good idea to defy subpoenas and lie to the FBI.
 
If more caches of classified documents are found to be in possession of Biden, will he keep getting the benfefit of the doubt by just saying he did not know he had them?

At what point, if ever, does this become unbelievable even to the democrat dead-enders?

I NEVER said he couldn't BUT he has to be able to show that a document was declassified he can't just say I declassified that in my mind a time ago.
If he could then ANY past President could just say he did the same thing and NOBODY has any way to tellif it was or wasn't because like everybody else he has to have somebody remark the documents
