Not true. No jury is going to accept his defense lawyer simply saying he declassified them. He will have to provide some evidence or testimony to support that claim. Of course, Trump could always testify under oath he declassified them and open himself up to cross examination never mind perjury.But since the president had the power to classify and declassify, if he was charged with mishandling classified information, the DOJ would need to prove that he did not declassify the documents.
Trump wouldn't need to prove that he had.
