Classified documents from Biden's time as VP discovered in private office, source says

I'm talking about statute 18 U.S.C. § 793(f) that makes the mishandling of classified material through gross negligence a criminal act. Intent isn't needed to violate that law.

18 U.S. Code § 793 - Gathering, transmitting or losing defense information​

(a) Whoever, for the purpose of obtaining information respecting the national defense with intent or reason to believe that the information is to be used to the injury of the United States, or to the advantage of any foreign nation, goes upon, enters, flies over, or otherwise obtains information concerning any vessel, aircraft, work of defense, navy yard, naval station, submarine base, fueling station, fort, battery, torpedo station, dockyard, canal, railroad, arsenal, camp, factory, mine, telegraph, telephone, wireless, or signal station, building, office, research laboratory or station or other place connected with the national defense owned or constructed, or in progress of construction by the United States or under the control of the United States, or of any of its officers, departments, or agencies, or within the exclusive jurisdiction of the United States, or any place in which any vessel, aircraft, arms, munitions, or other materials or instruments for use in time of war are being made, prepared, repaired, stored, or are the subject of research or development, under any contract or agreement with the United States, or any department or agency thereof, or with any person on behalf of the United States, or otherwise on behalf of the United States, or any prohibited place so designated by the President by proclamation in time of war or in case of national emergency in which anything for the use of the Army, Navy, or Air Force is being prepared or constructed or stored, information as to which prohibited place the President has determined would be prejudicial to the national defense; or

No willful intent needed for statute 18 U.S.C. § 793(f). Comey made the claim no rightful procecutor would take the case. Not that she couldn't be charged with crime.
The difference between armchair lawyers like you--parsing legalese with no context or real-world experience--and actual prosecutors like those that work at DOJ is that they know what flies in court and what doesn't.

Yes, but in fairness there was no infrastructure that complied with Federal law at the time. The silver lining of the HRC circus was that it exposed that up until then Secretaries of State had been playing roulette with private sector domains and afterwords the government got serious about official communications and provided government controlled servers.

Actually it did. One is still allowed to setup a private email server and even use it for political office. As long as you forward such work emails to an official work email account. But obviously, no classified information is allowed.
 
Garland appointed a Trump appointee to investigate this mishap by Biden. I will let the investigation play out although I still do not believe it is the same as what TFG did.

Now the GQP is talking about investigating this. They need to let the DOJ do their job. Not everything needs to be investigated by Congress. A waste of time and money
 
But he, supposedly, did not know he possessed these documents.
That's OK. He could've just thought, "Any documents ever found in my possession are hereby declassified."

No one knows how the documents ended up there. But we know for sure that the National Archives weren't looking for them--unlike Trump's stolen documents--and that the National Archives didn't repeatedly ask for them--unlike Trump's stolen documents--and that Biden's lawyers didn't falsely certify that there weren't any left after turning some over--unlike Trump's stolen documents--and the NA has given no indication it thinks Biden has any more--unlike Trump's absurd administration of losers.

I don't even know who the left is. Do you assume that everyone who speaks truly about Trump is a leftist?
 
To be honest I think it’s strange that Biden kept anything there. It’s an honorary office to go along with his honorary professorship that he’s used maybe 4 times since 2017 ahead of paid speeches. Why was Biden using it as a storage facility for the proceeds of his sticky fingers?

He "appointed" him as what? As far as I can tell, it is still being handled by the DOJ, where there is a clearly a conflict of interest, which is the reason that you would actually "appoint" someone from outside the DOJ.
