Northern California sheriff's deputies have shot and killed a 13-year-old boy after repeatedly telling him to drop what turned out to be a replica assault rifle, sheriff's officials and family members said.

Two Sonoma County deputies on patrol saw the boy walking with what appeared to be a high-powered weapon Tuesday afternoon in Santa Rosa, sheriff's Lt. Dennis O'Leary said.

The replica gun resembled an AK-47 with a black magazine cartridge and brown butt, according to a photograph released by the sheriff's office. Deputies would only learn after the shooting that it wasn't an actual firearm, according to O'Leary.

my first thought was why didn't he just drop the toy?
From the source: "I told him what I tell him every day," he said in Spanish. "Behave yourself." I'm guessing it was a communication problem. Although tragic, it sounds justified without further to go on. We now have pre-teens shooting people. However, this incident in no way reflects the need for more gun control.
 
It wasn't clear whether he pointed the replica assault rifle at the deputies or made any type of threatening gesture.
He better have made some threatening gesture.
Otherwise they had no reason to start shooting.

Stand in front of me and ignore multiple warnings to drop your weapon, you will get shot. Its sad that it was a kid and it turned out to be a toy. But just how was the cop supposed to know?

By not immediately firing when the gun isn't pointed at them, would be one way. Go figure!

Dont work that way. That cop has every right to go home to his family at the end of his shift as anyone.
From everything I have seen on it so far, looks like its a good shoot.
But it something that will haunt that officer to his grave.

According to the police report he not only did not drop the 'weapon' he turned towards them. They also found a fake pistol in his waistband. Dont know what the stupid 13 year old was thinking, but frankly, his age is irrelevant.

Dood...seriously? Someone is carrying a weapon, ignores commands to drop the weapon, and then turns towards you...and you want them to just wait? Til...when? After the first salvo?

This is tragic. Kids don't understand, hell adults don't either, that LEOs are afraid for their lives when they're out there.

The man was reportedly acting erratically near the Port Authority Bus Terminal, close to Times Square, when two officers confronted him. He then “reached into his pocket, took out his hand, and simulated as if he was shooting at them,” Police Commissioner Raymond Kelly said. The officers fired three shots, missing the man but hitting a 54-year-old woman in the knee and grazing a a 35-year-old woman in the buttocks, according to CBS News. “The only thing the individual had on his person was a wallet."

Good grief, if a police officer is pointing his weapon at you saying drop the tuna sandwich, you drop the freakin tuna sandwich. How stupid are some folks, and this level of stupidity deserves a Darwin Award.

Dont know...wasnt there. Given that the little ****head was carrying two fake weapons I start off with the inclination to believe the cops...some of that innocent until proven guilty thing. I saw pictures of the gun. There was nothing to indicate it was a toy or a replica. No orange band around the nozzle of the barrel. You would have had the cop wait til it actually began spewing bullets?

This is outrageous. If you read the story you see that the cops stalked this kid and then called out to him. He turns around in response to this and the cops shoot him dead. ****ed up. Maybe if we're talking gun control we talk taking guns away from cops before they shoot even more innocent people.

Of course I have a bias towards little ****heads running around carrying two fake weapons on their person. Because...you know...EVERYONE does that...

No language barrier. No way the cops know the inner workings of his brain. They know he is carrying a 'weapon' and that he reportedly turned towards them and raised the weapon.

The hysteria about him being just a 'boy' is childish emotionalism.

Small problem there..... As a competitive shooter ans someone who has self-defense training, one of the first things you learn is that ACTION beats REACTION almost every time. Waiting for that individual (I won't call a 13 year old with a firearm a child) to actually point the gun at you is an almost sure way to ensure you get shot instead of them.

That's in the article. They followed the kid and hid, called out to him and when he turned around they shot him. So it's more data analysis than anything else.

Yep, the cops over reacted to a kid with toys.

I know other Officers who would not have acted this way at all, so even if it turns out the Police were allowed to act in this manner, it just shouldn't be tolerated.

There is no problem with my position.
Notice the police are not saying he was holding the gun with one hand by the pistol grip. Just that he was holding it in his left hand.

I say they over reacted.

Perhaps you could post an intelligently honest argument that is relevant to other posts.
