Sure there is precedent: negligence law. Negligence is the failure to exercise ordinary care in your interactions with other people, that causes them harm. If you go driving on the sidewalk and hit a pedestrian, you can be held liable. If you refuse to vaccinate yourself and infect another person (who has themselves taken all appropriate precautions), you should be liable. If you want even more similar precedent, HIV+ persons have been sued for battery and negligence for failing to inform their sexual partners before having sex, and then infecting those partners.

As for proof, there are certainly many situations in which transmission from a particular person could be proven. Under ordinary negligence standards, only a preponderance of the evidence (i.e., more likely than not) standard must be met.

Also, if a few unvaccinated people get hauled into court and have to defend against lawsuits that they infected others, but those cases are later dismissed for lack of proof, I won't shed a tear about that.

Maybe you could cite a real life example where someone was convicted of giving another person a disease, other than a case that was blatantly intentional. And, how could you prove that the vaccinated person got the virus from a specific unvaccinated person and not from someone else or something else.

Much as I hate how the anti-science people put the rest of us at risk, I think the political harm of fighting with them is too much. Time to let them spread the disease and variants among themselves and die off, they'll do conspiracy nuttery forever otherwise. There is nothing more he can do than keep promoting the vaccines, do outreach and try to get trusted messengers involved. I think as this Delta variant runs rampant through the unvaccinated population it will scare some of the resistants into getting it. The huge majority of these young are not red MAGA hats. MAGA hats were not even mentioned by the CDC. This doesn't even count the millions and millions of blacks and Hispanics who haven't got the vaccine. My God, LA is in the grips of severe increase in cases. There is no "Other" option, so I could not vote.

However, IMO he should do NOTHING more other than to keep vaccines available, continue to protect the most susceptible (the elderly, but IMO the obese can take care of themselves), and otherwise let the virus run it's course and herd immunity deal with it.

I think he should push for a law that holds unvaccinated people personally liable to the extent that they infect vaccinated people or those who for whatever reason cannot be vaccinated.

Other than that, he should let the unvaccinated deal with the consequences of their own decisions.

If it gets to the point that the unvaccinated create a variant that is vaccine resistant, then next time around we can forcibly jab all the MAGA heads.
