Here's a case where I'd be all in on the cops ending a suspect's life on the spot. But, the Florida police officers showed incredible restraint. Hats off to them, I guess. I know I would not have been as gracious.

Holy crap!

In addition to two felony counts of aggravated child abuse, James faces counts of aggravated battery of an officer/firefighter/EMT, felony flee and elude, reckless driving and resisting arrest with violence, according to the booking information on the sheriff's office website.
James also faces a charge of aggravated battery on a pregnant woman, according to the booking information. The sheriff's office did not provide details on that charge.
This is nuts.

James was medically cleared from a hospital on Tuesday after treatment for what the sheriff's office said was a pre-existing condition.

Preexisting condition being what? He's a psychopath?

Sounds like some sick-ass joke. "Threw the baby over-handed and the Officer caught the child" People in Florida are used to hearing odd stories but this one is almost unbelievable.
Not sure what I would do. Probably either send the dude to an Insane Asylum or 5 years in jail, depending what a physiatrist would say, after an evaluation.

Answering only to the name of the thread...

Only when a police officer sincerely thinks his life is in imminent danger.
I'm a "heat of the moment" guy. Throw a baby, I'm giving a pass to whoever beats his ass.

Can't say I see the baby being "thrown" there......

......maybe it's because of the resolution.

This is nuts.

The simple truth of the matter in almost all cases of interaction with police when they are called to a crime scene is that a criminal was there first.

Some crimes are worse than others. Throwing a baby is pretty much at the top of the "that's pretty shitty" list.

Here's another.

The Sumners were bound and gagged with duct tape, put into the trunk of their Lincoln town car and driven across the border to a remote part of Georgia... Once in Georgia, the Sumners were forced to reveal the personal identification numbers of their bank accounts. The couple, blindfolded and bound, were then pushed into a pre-dug grave and buried alive by Wade and Nixon.

No matter what someone does, police do not decide guilt, culpability or punishment. So, I never support their shooting or "beating the hell out of someone"...except to the extent it is necessary to perform their jobs as law enforcement officers.

Even more nuts is your overreaction. Guns should be used solely in self-defense and "beat the hell out of a suspect"should absolutely never happen!
Obviously, I disagree.

People are human. IMO, the human reaction to a man throwing a baby is to bestow violence upon him. So, let's just say this. I would not prosecute a cop that decided to beat the snot out of this guy.

This must be an American concept - a pretty bad one.
There are at least two big problems with this concept:
1. how do you determine that a cop "sincerely thinks" than his life is in danger(and he doesn't falsely claim so)?
2. why should cops decide based on their personal and subjective beliefs whether they should take someone's life or not?

Would like to be beaten or killed based on what people sincerely think about you?

If I chucked a baby, I would expect to get my ass beat. Yes.

You should pay an bit more attention to the actual words - the reaction wouldn't be based on what you did, but rather on what people "sincerely believe" that you did! ;) Pretty big difference! ;)

Sure, lots of lynch mobs hung the wrong guy. Sucks to be that guy.

The child might get charged for obstructing justice...

We have to wait for the facts to come out... the baby might have been complicit in the father's efforts to cause a distraction and get away.

Maybe it's a flying baby.

People are human. And being a cop is a profession. People do all kinds of things that aren't professional...but that doesn't mean they should be acceptable in the workplace. Nor should they be tolerated.

If you or I did this, we would probably be in serious trouble. Retaliation by "kicking the shit" or killing someone as for throwing a baby wouldn't be self defense. It may be understandable on some level, but that wouldn't make it legal. Cops are, first and foremost, LAW ENFORCEMENT OFFICERS. If they can't handle following the law, they have no business being law enforcement officers.

Cops, should be held to a higher standard of following the law, not lower. If a cop did this, at a minimum, I'd hope they'd lose their job. In a more just world, they'd be behind bars.

I don't know. I got away with kicking the crap out of a stalker violating an order of protection. However, I did have to pay for his hospital bills, well sort of. We settled by his stalkee agreeing to drop criminal charges against him in return for him waiving payment of said judgement for the personal injury I inflicted.

Some ass-kickings are indeed justified.

Maybe, but cops are not judges, they are not juries, and they are not executioners. It is never justified for them to do as retaliation.

No, they are only human. And, humans have emotions. Very few things would stoke those emotions more than seeing a grown man hurl a baby through the air. Like I said, I'd never vote to convict a cop who lashed out at this jerk.
