We need a DP Court so that members can get a fair hearing.

Before I start my rant, which is likely going to earn me a permaban, here is my suggestion:

1) Upon receiving an infraction, a forum member should have the right, if he feels the infraction was unfair, to ask for a hearing. He would communicate this wish to one of the mods.

2) Upon receiving notification that a member wants a hearing, a thread should be made available in a sub forum that only the member who received the infraction, along with ALL of the mods, can see or post in.

3) The member would state his case why he feels the infraction was unfair. The mods would then respond to the member's statement. The member would then have one more chance to respond to the posts of the mods, after which the mods, AS A TEAM, would make their final decision, whether to keep the infraction, or rescind it.

It is a very simple system, designed to ensure fair play in the infraction point system.

The reason that I am bringing this up is because I strongly feel that I was infracted today by a mod who abused his postition.

My beef is over a post I made about politicians in Washington. It is as follows:

Anybody with the IQ of an artichoke can see the context here. I was calling Washington politicians morons. But I received an infraction because a mod arbitrarily decided that I was personally attacking another member of this forum. Now I must say that only a complete moron would see anything other than the attack I made on politicians.

I guess the whole point I am trying to make is that with the system that is in place, where the member IM's another mod and complains, does not ensure that the member will get a fair hearing if he feels he has been wronged. That is why I feel that a court system would be an equitable solution. 99.9% of the time, the mods do a bang up job. But mods are not God, although a couple of them probably have the unmitigated audacity to keep applying for the position.

Finally, before you all boot me permanently out of this forum, let me make a statement. Everyone here knows that I am not a complainer. I have received infraction points I deserved, and I have received a couple of infraction points I thought were questionable. I never complained about any of them the whole time. I accepted them with no hesitation, and that is the way it should normally be. But what happened to me today was complete bullshit. I did not break any god damn rule.

So, here is where it stands. I strongly protest, in no uncertain terms, the unfair and arbitrary infraction I was given today. In fact, and as you can plainly see in this post, I am more than willing to accept a permaban if some measures are not taken to enable forum members to have a fair and impartial hearing in front of ALL mods if he or she feels that they have been treated unfairly in the infraction process. For me, it is unfortunate, because I have been looking forward to getting that 10K up next to my avatar. But I am not a whore. I am willing to throw my entire history here away and go elsewhere if I have to. I think it stinks to high heaven when a mod can act as arbitrarily as as the Modbot who keeps interrupting me in this post, and uses about as much of his own mind as the Modbot to boot in the process.

................and if this did happen. I would hope that the mods, as a unit, would view it for what it is and reprimand whoever decided to lay it so thick.
 
I understand your complaint Dana. However, I fully and utterly disagree.

First off you don't see what happens in regards to the mod team, the infractions and warnings we give, and the flood of PM's we tend to get. You do not see the fact that likely 50-75% of all infractions (outside of *most* word filters and BN ones) are complained about in some fashion, be it small or large, by the offenders.

On ones that are clearly judgment calls that we as a community must trust mods to make, its VERY common to get complaints about it because people rarely come to a similarly negative judgment on their comments.

A "Court system" as you suggest would do nothing but slog down the mod team into non-stop bureaucratic red tape, constantly dealing with every little complaint lodged, and never actually doing anything else on the forum for the most part...including posting.

Additionally, there IS a method for doing essentially what you said. Indeed, in recent weeks, there has been an old and new infraction turned over due to the mod team putting its head together and discovering the true reason for something occurring which cleared the original posters name. There was another instance where a person PROPERLY filed their complaint, it was posted up as procedure goes into that persons infraction thread by the Mod, the mod team discussed it, and it was over turned.

Guess what, if you had followed PROPER procedures instead of this strange public martyr-esque display, yours may've very well been over turned as well. In something that was essentially the same type of thing you were asking.

Instead, you decided to further buck the rules and insult the mod team? Why? Did you think THAT kind of action was going to change anything? Did you think leaving with that kind of attitude would make us all go "Awww shucks will miss Dana".

You're a fine poster. I disagree with you often, agree with you a bit too, but you're generally a good poster. And I'd hate to see you go. But I'm not going to cry in my beer over it, espicially when you're leaving for reasons that frankly seem to be utterly and completely flawed. You're mad and leaving due to not being able to do something you could essentially do but chose not to do.
