You might be right, actually. I was going to edit and hedge a bit. If they were wanted for murder (considered dangerous fugitives of justice), maybe then they could. But I don't see that happening here. I don't know of the legal basis for it anyway.

He can certainly attempt to. I'm just wondering if federal agents and their superiors, who are well versed on the law, are going to knowingly violate dual federalism. They take an oath the Constitution just like members of the military do.
