In 2020 it was a toss up, with Trump holding a slight advantage for incumbency. Biden won. It was close, and well within the margins. In 2022 the pollsters were again very close to the final result.

On the one hand, Trump said he wanted to ignore law and treaty: “why can’t we just send them back?” On the other hand ICE was letting asylum seekers into the country during Trump’s time. I volunteered in El Paso in 2018 with a church sponsored group, and each day ICE would let us know how many migrants they had screened in were to arrive.

The law is a bitch sometimes. The controlling legislation is the Refugee Act which says anyone can apply for asylum at a border, port of entry or from within the US “irrespective of (their immigration) status.” The relevant treaty states that “no contracting state” — the US is one — shall return someone to danger. The specific treaty is the Protocol Relating to the status of Refugees. Again, change the language or vote for Trump as he cares nothing about laws and treaties.
