WASHINGTON (AP) — Former President Donald Trump is asking the Supreme Court to extend the delay in his election interference trial, saying he is immune from prosecution on charges he plotted to overturn his 2020 election loss.

His lawyers filed an emergency appeal with the court on Monday, just four days after the justices heard Trump’s separate appeal to remain on the presidential ballot despite attempts to kick him off because of his efforts following his election loss in 2020.

“Without immunity from criminal prosecution, the Presidency as we know it will cease to exist,” Trump’s lawyers wrote, repeating arguments that have so far failed in federal courts.

The Supreme Court needs to turn this around on a dime and defer to the lower courts immediately. This is beyond blatant in its attempt to to delay his trial and nothing more.

That's a pretty big ask. I bet it gets declined. They might give him the benefit of the doubt on some things but this is too much to ask of them.

We're headed for chaos & violence which are the tools he failed with on J6. His peeps want to give it another try.
 
"Trump’s legal team has ascribed partisan motives to the prosecution’s push for a prompt trial. “Conducting a months-long criminal trial of President Trump at the height of election season will radically disrupt President Trump’s ability to campaign against President Biden — which appears to be the whole point of the Special Counsel’s persistent demands for expedition,” the former president’s lawyers wrote."

They can say that, but they have nothing to back up those empty words. It is not the whole point at all. The whole point is that the prosecution has strong evidence Donald broke the law. The most obvious reason to conduct a timely trial is because the defendant could use the power of the office he seeks to avoid prosecution all together. Of course the prosecution wishes to proceed while it has the evidence and the chance before the defendant gains the power to elude justice.

Possibly true, but it has no bearing on the case other than further evidence of Donald's persistent lies, and his ability to motivate the angry crowd that tried to defeat the will of Congress to act in it's Constitutional capacity.

Trump ain't saying he didn't do it

Trump did the things they say he done.

I suspect Trump & conspirators have not denied any of the allegations in re the fake electors scheme because the prosecution truly has all the documents the prosecution say they have in the indictments.

Including the emails and memos where Trump and conspirators outline the fact that they could not make legit electors and that the conspirators planned to submit the electors even if they failed to win the relevant court cases (despite what they told some of the fake electors).

Exactly, Donald's legal team has nothing more than unsupported wild innuendo. Justice demands their flimsy claims be dismissed and the trial proceeds with all due alacrity.
 
Does this mean SCOTUS will hear the case? Could they still turn it away and rely on appeals court decision?

Supreme Court Gives Prosecutors a Week to Respond in Trump Immunity Case​

The schedule the justices set was not particularly speedy, though nothing prevents the special counsel from filing sooner than the court’s Feb. 20 deadline.

The Supreme Court on Tuesday gave Jack Smith, the special counsel prosecuting former President Donald J. Trump, a week to respond to Mr. Trump’s emergency application asking the justices to halt an appeals court’s ruling that rejected his claim that he is absolutely immune from criminal charges.

In asking Mr. Smith to respond by Feb. 20 at 4 p.m., the justices did not set a particularly speedy schedule. The court often asks for quicker responses to emergency applications on what critics call its shadow docket. But nothing prevents Mr. Smith from filing sooner, and he probably will.

 
They left it to him. It doesn't take a rocket scientist to know Smith's is likely already on the way.
