Trump administration bars Harvard from enrolling foreign students

You folks are trying to get around immigration laws and who decides them, under the Constitution (the elected political bodies), of who can lawfully enter and stay in the country.
The government must abide by the constitution.
It's not going to work.
The constitution will be and is being upheld. When Trump violates it, the courts step in and stop him. It’s why he keeps having his ass handed to him in court.
 
Whether the actions of Washington DC discourages foreigners attending Harvard or other American schools has nothing to do with due process.

The feds asks for the information. Harvard can go to court to fight.
There. That's due process.

Maybe revoking the ability of Harvard to enroll international students is an extreme response to the school not protecting the civil rights of Jewish students.

But the real question here is who gets to make that decision. And the law is pretty clear.
It's not the courts.
Yes, it is in fact the courts.
 
I support it as well. But people here on student VISAs engaged in racist or anti-Semitic behavior can be shown the door as far as Im concerned.
I feel that anyone here on a student visa that wears a MAGA cap should be shown the door.
 
To defend such an action the administration will have to present its reasoning and allow for discovery on the personal grudge front.
If foreign students cannot attend Harvard, but are cleared to enroll at other US universities, that makes the “foreign students” aspect suspect, imo. Harvard is being singled out, which seems. To be on shaky legal ground.
 
So here is a thought...

Harvard partners with other schools.

Transfers the students to other schools.

Students are enrolled at the other schools.

Students take classes at Harvard.

The Other School accepts the Harvard classes as transfer credits.

At the end, Harvard accepts the transfer credits back and they graduate from Harvard.

It's the injunction that stops the administration from doing anything while the courts weigh in.
A good thing. Nobody, not even Trump, is above the law. He only thinks he is, and clearly considers adversarial encounters with the legal system as an occupational hazard.

OK if you replace "shaky legal ground" with BS rules that were made up on the spot as an obvious political retribution.
 
Harvard loses their certification under SEVP. They can’t even enroll foreign students. Maybe they should follow the ****ing rules.

Without a warrant DHS can lawfully obtain only the narrow SEVIS data set: identity details, address, program/grades, status changes, and disciplinary action tied to a criminal conviction.

Everything else such as non-criminal discipline, non-criminal misconduct, and protest activity falls outside 214.3 and is shielded by FERPA unless DHS brings a valid subpoena or court order.

Maybe the Trump administration should follow the ****ing law.

The Trump supporters want Trump to be a dictator because they think Trump will punish non-white people.

It's not going to work.

Trump and his supporters are racists and fascists. That's the bottom line. And that's why no logical argument can convince them.

They don't care about the law.
They don't care about the Constitution.
They don't care about anything except making non-white, non-christian, non-males suffer.

So what if 'black' or 'brown' students of Harvard were being harassed by 'international' students?
Are you saying it would be wrong for Washington DC to try to protect their rights? And are you suggesting that there is nothing to be done about the 'international' students doing the harrassing?
In your hypothetical situation, a segment of foreign students are harassing. The response of no foreign students shall receive visas is an inappropriate response since it victimizes students not harassing anyone.
 
Not that I agree, but I imagine if they revoke the legal status for the individuals, they don't need to do anything (and have no power to do anything) to Harvard. Harvard has no power to grant legal status
That's not what they're doing. They're revoking Harvard's cert and using that to force students to transfer or face deportation.

If Harvard keeps them anyway they may have ICE roll through campus grabbing those students
That's on hold for now, per the court ruling.
 
Don't forget protection from people brighter than them. It's what MAGAs fear most; people with a functioning cortex.
Since COVID they have certainly been conditioned by MAGA media to react to the educated and to experts with distrust and contempt.
 
The non citizen parents were deported. They chose to take their kids with them.
Doesn't sound like they got the chance to decide. From the link:

Gracie Willis, an attorney with the organization, told NBC News that the boy and and his 7-year-old sister were detained by U.S. Immigration and Customs Enforcement on Thursday. They were taken to El Paso, Texas, and flown to Honduras first thing Friday morning, Willis said. The 4-year-old boy, who was actively receiving treatment for a rare form of cancer, was flown to Honduras without his medication, according to Willis and the National Immigration Project. Attorneys were preparing a habeas corpus petition when the children were taken out of the U.S. on an ICE charter flight before the petition could be filed, Willis said.
