Issue:
Whether the Protecting Americans from Foreign Adversary Controlled Applications Act, as applied to petitioners, violates the First Amendment.

The Court has ordered an expedited briefing schedule and set oral arguments for January 10.

The parties are directed to file electronically simultaneous opening briefs, limited to 13,000 words, and a joint appendix on or before 5 p.m. (EST), Friday, December 27, 2024. Reply briefs, limited to 6,000 words, are to be filed electronically on or before 5 p.m. (EST), Friday, January 3, 2025. Any amicus curiae briefs are to be filed electronically on or before 5 p.m. (EST), Friday, December 27, 2024. Booklet format briefs prepared in compliance with Rule 33.1 shall be submitted as soon as possible thereafter. The case is set for oral argument on Friday, January 10, 2025.

They have also indicated they will defer any injunctive relief to no earlier than the conclusion of oral argument.

It is their prerogative.

While I am not a user or fan of TikTok, I am a strong First Amendment supporter. Government must achieve an EXTREMELY high bar to shut speech down.

I will wait until the Supreme Court rules to render judgement, as there are multiple nuances as to how they could rule.

IMHO, extending 1A rights to foreign adversaries was never original intent, but we’ll see how the SCOTUS rules.

Not saying it is a good idea or not, until I see the final ruling.

But clearly worth review.
