they didn't now it was a bb gun. the kid had removed the orange signal tip to show that it was a bb gun. without the tip it really does look a like 1911 colt.
I hope you would use more logic in your posts on things like this.
the cops can't tell at a distance more so with it in his pants that it is a bb gun. if you look at the gun itself it looks very real.
and a 45 cal gun is nothing to sneeze at. it can do some serious damage.
cops put themselves into those situations all the time that doesn't mean they should have to ask 100 questions before they do something.
could the approach been better probably but they got a call about a kid walking around waving a gun at people. that is far more dangerous then what the cops were doing.
The kid probably was breaking the law. I don't know what the law is in Cleveland but in in most places pointing a firearm, even a pellet gun, at people is illegal. Besides, the responding cops would have no way to know whether the gun was real or not as they approached.
In this particular scenario the primary problem was in the way the cops approached. There did not appear to be an imminent threat to anyone at the time they came on the scene but the driver certainly - and unnecessarily - put himself and his partner in a potentially deadly situation. Self defense generally goes out the window if you knowingly and willingly go from a safe position to one of imminent danger unless you are doing so to protect someone else who is in such danger.
As a previous poster has noted, there was no one around outside where the kid was playing, so no he was not waving a gun at people.

Whether you're holding a toy gun or a real gun and pointing it at anybody or anything when the cops show up, you're not bright. I wouldn't give my kid a BB gun that looks so much like the real thing.

Cops are held to the same standard as you and I are. If they themselves aren't in imminent danger and nobody else is either then they can't claim self defense if, after recognizing a potential threat, they put themselves in a dangerous situation.

I wouldn't let my kid roam around a public park with it. that is the real question. of course the kids parents probably aren't home.
stupid on his part unfortunately it was a very costly mistake.
the judge doesn't matter it is the GJ that will still decide.

100% wrong, but you are letting your bias over rule reason and logic.

But do tell how you think it is influential? Especially as we can see that he is wrong about what the video shows.
All he is doing is showing he is a biased individual.

It's hard because the police seemed to have acted way too fast without taking anything into consideration.
But at the same time, the way that kid was pointing the pellet gun... And it's not like these things look like toys.

It's definitely going to be tough. I don't know if murder is the right sentence though. And for that reason, I think that if he goes to court with a murder charge, it's most likely going to be dropped.
Lol. That's funny, you cannot accuse Lutherf of an anti-police bias!
Let's hope this starts a trend, and we settle police brutality in open court rather than secret grand juries.
It's without a doubt that the cop is going to get roasted in civil and criminal court (somehow).
I just cannot, personally, see this as being MURDER.
Also, this was from a previous thread months ago. This was the EXACT pellet gun the kid was holding at the scene.
