"Speaker Mike Johnson (R-La.) on Tuesday drew attention to Congress’s power over the federal judiciary as Republicans plot how to legislatively channel their outrage over district judges who have blocked Trump administration actions.

“We do have authority over the federal courts,” Johnson said in a press conference Tuesday. “We can eliminate an entire district court. We do have power over funding over the courts and all these other things. But desperate times call for desperate measures, and Congress is going to act.”

Johnson clarified that he was not calling to eliminate courts, but rather meant to illustrate Congress’s broad scope of authority, Punchbowl News reported."

Please do. I’m begging you. Do it.

The delay in Federal Courts is already years. Cut those courts out and bam it is a decades worth of delays.

Before the accused can go to trial the witnesses will die from old age. People getting away with crimes because they can’t get a speedy trial. Awesome plan Republicans.

Of course the muppet is going to assist with the destruction of the United States.

WTF? Johnson clearly is a spineless enabler of Trump that will not be well regarded in the American history books, though he may become a hero of the 4th Reich. It seems pretty clear that Johnson lied when he took the oath of office as threatening to shut down the courts because they slapped the POTUS is NOT upholding the Constitution against all enemies foreign and domestic, but actually siding with the enemy against the Constitution.

When are "the people" going to wake up and realize this is not going to end well unless we standup up to Trump and his spineless sycophants that are selling out one of the greatest civilizations this world have every seen. Unless we stand up, this will not go well of 95% of Americans, who will suffer physically, emotionally and financially unless the current trajectory is significantly altered....

Neat! Just don't complain if you lose the next election and expect the courts to curtail the opposition party's actions.
:)

Obviously, courts making decisions restraining a president who has shown contempt for the law is the very definition of “desperate times.”

Vito Corleone couldn’t have said it better, Speaker Johnson.

For me that is a clear admission by Speaker Johnson that they know what Donnie and his partners in crime are trying to do is unconstitutional and illegal. And their solution? Get rid of the courts.

"It is telling that Democrats want to change the system that has guided our nation since its founding simply because they disagree with some of the Court’s recent decisions."

Speaker Johnson, July 2024

Sure. The Republican party can eliminate the republic, and is trying that out. However, times change, and people keep records of who does what. There will eventually be a response.

absolutely true regarding inferiors courts ..although getting Congress to act..is "painfully slow" to not happening

Gangsters? Nonsense. He is simply responding to the fact that the otherwise powerless Democrats in both the Senate and House, and the loss of the White House have fallen back to their prepared "Plan B." I.e., in the event they lose, while they had power try fill as many Federal Court positions as possible at all levels, District, Region, and SCOTUS.

Biden was only able to get one SCOTUS (Ketanji Brown Jackson) appointee, IMO an openly radically socialist leaning member who will vote for Democrat issues, but Biden did get 187 District Court appointees during his term. The most of any President before him. THAT is where most of the Democrat legal advisors are "Forum Shopping" seeking these biased judicial rulings. Trump did appoint three SCOTUS members, including Amy Coney Barrett, but clearly, she is not a partisan supporter of his.

However, regardless of how you and other Lefties "feel," Speaker Johnson is correct.

"Johnson clarified that he was not calling to eliminate courts, but rather meant to illustrate Congress’s broad scope of authority.

Article III of the Constitution specifically vests judicial power in the Supreme Court and in “inferior Courts as the Congress may from time to time ordain and establish.” The structure of the district court system, and how they are funded, are determined by Congress." Link

Thus, it is possible for Congress to pass one or more laws limiting the power of the Judiciary when it comes to the plenary powers of the Article II Presidency.

IMO, as one example, Congress could pass legislation to not only re-affirm the old law Trump is currently using to deport illegal aliens from the USA, but bring it up to date to specifically include the power to detain/arrest and deport any dangerous, or otherwise deleterious illegal migrant without recourse to appeal.

The Speakers hubris is astounding. He may as well come out snd state he supports an autocracy….

I like another idea from Speaker Johnson. Passing a law making it illegal for a Judge to issue an order that has effect nationally. I can’t wait for that one. I am honestly excited.

Because there will be a Democratic President again. And all this power you are pushing for Trump to have, will then rest on a Democrat. Can’t you imagine it?

The Democrat steps into the White House for the first time and signs an Executive Order redefining the Second Amendment to limit firearms to single shot or mechanically activated. In other words no semi automatic weapons.

You can’t just run to one judge and get an order to stop it. You have to find 94 Judges as each Judge is limited to what happens in his district. He can’t order anything that would affect something nationally. So you would need 94 lawsuits filed, there are 94 districts in the Federal Court System.

If One Judge says the President has all the power in the world. He doesn’t feel that thwarting the will of the people is something that is right. Well in that District the Order is valid isn’t it? You can’t just scream but this Judge over here said it was wrong. All the while semi automatic weapons are being rounded up and crushed under bulldozers or otherwise rendered non functional aren’t they?

I’m betting every single one of the President has all the power in the world folks, will be screaming that the Democrats are defying the judges.

Nonsense. Thanks to the Biden Administration tens of millions of unvetted migrants have made an incursion into the USA. Regardless of whatever weird rational the Democrats want to use to let them remain, there are serious issues caused by many if not most of them. Among them are hundreds of thousands of violent criminals who engage in all sorts of criminality, including child and adult prostitution, harmful drug production and sales, rape, assault, battery, robbery, grand theft auto, arson, and murder as well as social terrorism to make civilians fear to report them.

We can't get our INS court system to effectively work to process them, many also simply refuse to return to court for fear of deportation.

IMO the only reason Democrats support this mass effort to stymie the proper processes is the same reason they supported it occurring under Biden. The Democrats are losing ground with American voters. They've gone too far left of center and know this is a problem for them. So, solution is to IMPORT a mass of grateful new dependents, and then continue to buy their future votes. Nothing different from what they've been trying to do to actual Americans, which hasn't been working out too well lately.

I don’t get why there hasn’t been a deeper dive into Johnson’s finances and living arrangements.

After the outgoing one term President John Adams stacked the lower courts with partisan hacks President Thomas Jefferson with Congressional approval dissolved the lower courts. Congress declined to appropriate funding for the SCOTUS shuttering it for its first term. These actions didn’t doom the Republic. They sent a message that the judiciary wasn't a superior branch to the other two.

The wild demagoguery proclaiming the destruction of the Republic if Speaker Johnson's remarks come to pass just illustrates the absurd ignorance of contemporary Democrats.

Oh you don’t understand. I think this is great.

If the Democrats win the White House, expect a lot of Executive Actions. And there won’t be any way to stop them. Among the ideals from Republicans is to make it illegal for a Judge to issue a nationwide stay or order. That means that the Republicans would have to run to 49 different district courts to try and get an EO stopped nationwide. Unless every Judge agrees, then the order will be valid in the district the Judge represents. Of course the Republicans have defined legally binding as only when the Judge writes the order up and signs it.

The best part is if the Republicans get rid of a bunch of courts the delay in getting their request actually heard by a judge will be days or weeks.

This is awesome. I’m so looking forward to the Republicans gnashing their teeth and screaming about imperial Presidents.
