No, it's not irrelevant. My assertion is that there is no operative law at the state or federal level that clearly relies on Lisa's idea of "neuroscience" in order to define gender. I've already referenced two states (MA and NY) that specifically rely on a belief standard.

To prove me wrong you're going to need to cite such a law. Can you?

No, you still don't get it. I'm saying that if there are laws that rely on the neuroscience research you keep posting then surely you can find such a law. You cannot, and we both know it.

Politicians don't debate and approve medical or any other field of science. It doesn't work that way. Politicians also dont approve the germ theory, heliocentrism, or evolution, so feel free to claim that they are also a religious belief.


How many times does this need to be explained to you before it sinks in?

There is no such law because politics doesn't work that way. There is also no law about race, religion, sex or ancestry either.

Sure they do. For example, Montana, Kansas, Texas, and other states define gender based on the science of DNA. It is a verifiable, highly scientific method of determining who is a woman and who is a man.

They stand in contrast to states like MA and NY which impose a faith-based standard.

Gender is not based on DNA. biological sex is based on DNA but gender is not.

Those are conservative states trying to write laws that deny that gender identity exists by claiming that gender is based on DNA.

Correct, they're basing their definition on the well established scientific principles stemming from the study of DNA. The definitions in blue states don't do that. They rely on unscientific principles like a "deep inner sense" or a "perception" of gender.

I haven't seen these laws, but I'd bet money that they are just an oversimplification of the actual science by conservative politicians, even if they claim to be based on science.

The issue is whether blue-state gender laws are based solely on a belief standard, and they are.

The specific reason that the courts said they are protected is that they are covered under existing sex discrimination laws. Not because the courts gave any credence to your "gender identity" theology. For example, if you wouldn't fire a woman for wearing a dress to the office, then you can't fire a man for wearing a dress to the office. If you wouldn't refuse to hire a man for being married to a woman, then you can't refuse to hire a woman for being married to a woman. OK, fair enough. That's sex discrimination, nothing more.

Very much like with the Plessy decision, where the courts ruled that racial segregation laws were not unconstitutional because they effected whites and blacks equally.
