It will be interesting to see how this plays out. As written, it may pass. I'll bet the amendment process could kill it though.

It repeals Section 1738C of title 28 and directs all states, territories, etc. to recognize same sex marriages. This could become a tenth amendment problem.

The TENTH (civil war) amendment has ALWAYS been the problem.

Agreed. Like abortion, same-sex marriage is a matter for the states to decide.

It might pass in Congress, but the U.S. Supreme Court probably would swat this bill down based on 10th Amendment statutes.

As the Fourteenth Amendment makes very clear, states cannot forfeit rights to people.

Nope. 14th amendment is what controls this. See obergfell v hodge. States can not ban marriage to same sex couples. Just like they can’t demy marriage to interracial couples.

We don’t have 50 countries, each to decide whatever on their own. The civil war 10th amendment is the bane of our existence.

How about getting government out of those decisions entirely and leaving it to individuals to decide for themsleves?

And yet they already decided same sex and interracial marriages are constitutional on solid grounds, unlike the flimsy arguments for Roe.
