The function of the court is to instruct as to the kind of information which is violative of the statute, and that of the jury to decide whether the information secured is of the defined kind. It is not the function of the court, where reasonable men may differ, to determine whether the acts do or do not come within the ambit of the statute. The question of the connection of the information with national defense is a question of fact to be determined by the jury as negligence upon disputed fact is determined.

Remember these three words. OBSTRUCTION OF JUSTICE. Those three words are being attributed to a former POTUS who is now a private citizen, just like you and I are private citizens, and those three words are being attributed to one Donald J. Trump by the U.S. DOJ. There's a train a comin', and I'm ecstatic that I'm no where near that train track like private citizen DJT is. 'Play stupid games - Win stupid prizes.'

I don't think there is any mention he has to beg CNN or the FBI to do it. I am no attorney but it appears that all he has to do is to make a declaration.
The onus is on Trump to prove he declassified documents and not on others to disprove it.

Trump claimed to have blanket declassified docs but none of his national security team know anything about it. So, when a underling picks up a file that says “Top Secret” is it classified or not? The purpose of classification is to assure that unauthorized people don’t have access.

Trump is making an absurd assertion and it’s obvious.

From what I understand, when he declassifies stuff he is supposed to log that and the relevant agencies are notified. They apparently weren't. That may simply be another example of Trump's carelessness, however, and anyway these don't seem like a hard and fast rules, given the great discretion a president has.

But really, no one has come forward to confirm Trump's story about automatic declassification. Based on what we all know about the guy, this is nothing new, just Trump saying whatever is convenient at the time to avoid facing up to whatever trouble he thinks he might be in. He is very light on his feet that way. And when he is nailed by a question, he just walks away.

If you want me to engage in a discussion, you need to put in more effort to actually understand the issue - rather than posting the first hit you get from Google.

Attorney-client privilege doesn't come from the 4th Amendment, or any other part of the Constitutiin. It is older than the Constitution, by hundreds of years.
All of the amendments in the Bill of Rights are, your problem is you think you must be the smartest guy in the conversation and then you wonder why you are suddenly talking to yourself.

Spare me the ****ing arrogance. The point is the 4th and attorney client privilege overlap in areas of the law.
