Karen Read Trial - Take 2 (2 Viewers)

He admits that the timestamp was present in Axiom at the first trial, and still appears in the data with Axiom today.
 
He admits Celebrite changed the software because of the events of the first trial, based on what he told them.
 
Admits he has a reasonable doubt about how the search record on McCabe's phone was deleted.

That ends the cross of Whiffen. Brennan begins redirect. I'm a bit over 2 hours behind.
 
On redirect, he's refusing to say it is his opinion with a scientific degree of certainty that the phone was next to the flagpole all night. Brennan is pushing him, but he wouldn't say it yesterday, and he refused again today so quietly that judge Bev is making them turn off the AC so he can be heard over the vents.

Previously he said it was impossible to say, now he's saying it's difficult to say (whether the phone was in one place all night such as next to the flagpole.)

Direct goes pretty boring. 90% defending the Google search, 10% JEN! I HIT HIM! Her story is all borked up though. She previously testified she saw Read's SUV out front around 12:40am. Read was already home by then. (1 hour behind.)
 
Dang that was the least natural way to work in the search for its raining men. Just awkwardly brought it up as an inside family joke at this party because her nephew showed her the other day.
 
She just testified on direct, right after she sent the text to O'Keefe that said "here!?" she saw them out front.
 
Her times have suddenly become a lot more fuzzy, when it comes to when Higgins left, and when she left, she couldn't really say, except she thinks maybe she left 15 minutes after him, and he left first, but who even knows, she doesn't.
 
Ever changing story from McCabe. Making up new lies to cover up ones busted during the first trial.

For example, upon arriving at 1 Meadows, last time she gave the whole story about being showed the taillight and everything, now it skips straight from getting out of the car to it being weird Read didn't take off her shoes in the frantic search for O'Keefe. I think taking the shoes off in that situation is weird.
 
The testimony that she and Kerry gave last trial where they both swore and were certain that the taillight tour happened when they arrived has changed. When a video proved that wrong at trial, McCabe lost her memory now and maybe it happened when they left. Conveniently when the Ring footage went missing. And Kerry Roberts says McCabe influenced her testimony before to lie.
 
Jennifer McCabe says with the weather, it took her 10 minutes to get from 1 Meadows to 34 Fairview. That means Read left 34 Fairview around 12:26am, 5minutes before the Commonwealth alleged the collision happened (based on the Lexus data, which conflicts with O'Keefe phone data because it has him still using his phone after that too.)

McCabe is done for the day. Brennan threw a fit in his argument for a motion to keep ARCCA out. Defense nuked his argument because the rule he is citing doesn't apply to conversations between attorneys and expert witnesses. Bev ruled against him on the so called discovery violations he's been crying about.
 
Alessi did a great job with the first witness about how far the flagpole is from the house. His phone could've been in the house.

Also, that he was unlocking his phone after the time Read had left and the Commonwealth says is the time he was struck. That's kinda bad.

As it should have been, since the bluster and outrage about discovery violations from Bev and Brennan was all a show from the start, based on lies as I said.

Not today, they're defense witnesses. But they will testify during the defense case in chief. Today is more Jennifer McCabe and who knows after her.
 
Back in court with the fan, should be starting any time with resuming the direct of Jennifer McCabe.

 
Brennan really likes his story about Read now being jealous, and having McCabe bring up other women for motive during the drive. So dumb. Arguing in front of the judge to let him tell more of the story. She limited it to Bella's mom I think.
 
Here we go. Let's let the Commonwealth waste their time on establishing a motive for the alleged accident, then on cross her claws will come out as her lies are exposed, again.

For the first time, she claims she did chest compressions on O'Keefe after calling 911. This has only ever been mentioned before in Kerry Roberts testimony earlier in this trial, and isn't corroborated by any other evidence, video, or contemporaneous reports or testimony. Sure trying to improve her image though. Doesn't look so good just sitting in the car like before.
 
She told the 911 operator "he's gone" when asked if they could do CPR, then we're supposed to believe she went and took over. And we can hear Read in the background clearly having a genuine emotional reaction to the situation, while McCabe is sitting in the car coldly telling them he's gone.
