Wow! You are completely off base. The special master would determine only if any of the documents are client attorney privileged and therefore off limits to be used in criminal proceedings. He/she would not determine if the documents fall under the defense or espionage act.Which is all the more reason for a special master to evaluate if the recovered documents meet the criteria.

Just to piggyback here: You can delegate tasks; you cannot delegate responsibility. You can't say "I told my lawyer to do ABC. He didn't do it, so I'm in the clear." Nope, nope, nope! Doesn't work that way. It is ultimately Trump's responsibility to comply with the subpoena. If he didn't, it's on him, not his lawyer.And that doesn't work as a defense. The obligation to comply with a subpoena and/or the applicable laws is Trump's, and he cannot shift that burden to his attorney.
Sure, a prosecutor might take the attorney's assertions into account when deciding on the charge and the judge or jury might consider "But my attorney said I was good!" defense at some point, but then the question is then what exactly did Trump "order" them to do? What did Trump do to satisfy himself that "the documents had been returned." Did Trump go through his private files, give access to ALL those private files to the attorneys, give them access to his safe, to the storage room, did Trump direct them to go through those boxes page by page, and did the attorneys assert that they did this review, and found no documents marked classified? Where/when/how did the attorneys represent to Trump that they did these specific steps and found nothing? Etc......
Again, I do not care at all if the attorneys were idiots and didn't CYA big time before signing the response, if that's what happened, without Trump also asserting to its truthfulness and completeness. IMO, if they didn't CYA and are disbarred for making false statements to the court, no loss to the legal profession.
But that simply doesn't relieve Trump of his legal burden. If he hired incompetents who e.g. lied to Trump about the steps they took to satisfy the subpoena, that is still Trump's fault, because he didn't take the steps necessary to verify their alleged efforts were sufficient.
So, what you're saying is that the FBI is accountable for what the WaPo reported? If what actually happened doesn't line up with what WaPo reported, then the FBI looks foolish?But this isn't the win Trump thinks it might be. Assigning a Special Master would only help in two areas:
1) Identifying what items belong to Trump and what belongs to the U.S. Government.
2) Delaying the federal government from taking any further steps, i.e., legal action, if any, in their case against Trump on this matter of improper/illegal possession of classified documents.
It's item #1 that might help Trump the most. How? Remember this WaPo article, "FBI Search of Mar-a-Lago related to nuclear documents"? What if it turns out the FBI didn't find any such documents at MAL? Would this be seen as vindication on his part where he could further claim the "deep state" is out to get him? It would certainly make the government look bad because there would be no accounting for the "missing" TS nuclear tech documents. Same could hold true for no evidence of classified documents outlining the names of "human assets" stationed abroad who have recently died per reports. The government could never reveal the truth on either matter. So, Trump could come out smelling like a rose while the government has egg of their face because the norm is "we want to keep our secrets secret."
Point is, the government comes out looking bad either way. If they did find such information during the MAL search, they may have to provide some details as to what they recovered. But if no such documents were found, they really end up looking foolish which I believe is exactly what Trump's counting on.
If this judge were to order a special master AND the DOJ objected, they could file a motion that says THIS judge has no jurisdiction. That immediately moves it out of her court. The judge herself cannot rule on whether or not she has jurisdiction. If another court agrees on the DOJ motion, it will be up to Trump to refile the motion in the correct court.I don't really think it matters. Trump hasn't asked for any actual relief to this point, so to the extent the judge effectively pre-hears their whining, and rules on the issues, it's not going to slow down the DoJ. They've already been through everything, and are as we speak engaging in a more thorough review, and Trump didn't even request that this process stop between now and Thursday. Further, if Trump wants to claim "executive privilege," the PRA, the statute, says the court that must hear that request is the D.C. district court, not this judge in Florida. I don't see how she gets around the PRA on that. And the PRA is very specific about those competing claims, between the current and former POTUS. If/when there's a conflict, the sitting POTUS makes the call, and the purpose for disregarding Trump's wishes in this case is pretty obvious.

Yes, the same law firm that gets dirt on people and who Hillary paid millions to frame Trump for Russian Collusion. here the same firm that told her it was OK to destroy evidence was the firm that hired Fusion where the wife was the main character and married to Bruce Ohr, an FBI agent. How any law firm gets away with the destruction of evidence is beyond me unless........the FBI told them it was OK because they get favors such as plush offices and who knows what else (bribes) from them.

What I am saying is merely getting appointed Attorney General does not magically endow you with the supreme power of being right on every issue, all the time. I do not dislike Jeff Sessions. I personally met him at a rally for Ted Cruz, shook his hand and chatted with him, however in the legal field, I have my favorites. Some are better then others. My favorite would have been Representative Trey Gowdy. In civilian life he was a top notch prosecutor very knowledgable and I don't think he ever lost a case. I don't dislike Bill Barr either, however he did get his feelings hurt over Trump bashing him and as of late has not been all that objective. Well! I may have gotten this one wrong!
After seeing Trump's original filing in this matter last week, I thought the judge would laugh it out of court!
Apparently last Monday, the judge asked for additional clarification & additional supporting evidence from the Trump team. And, it looks as though she may have gotten it!
If a Special Master is appointed, it may be a big win for Trump & the GOP, as this adds a huge delay to the case including a delay in the possibility of filing charges. I'm thinking this might get them clear of the mid-terms, and get the case out of the media.
We'll find out Thursday . . .
