Judge blocks Trump admin from withholding funding to 34 cities and counties over 'sanctuary' policies

A federal judge halted efforts to withhold grant funding for "sanctuary cities."

A federal judge halted the Trump administration's efforts to withhold grant funding from "sanctuary" cities and counties for not cooperating with immigration enforcement.

The 15-page order from Judge William Orrick grants a preliminary injunction in the administration's effort to withhold funds and expands the number of cities that federal funds can't be withheld from due to their "sanctuary" status for undocumented immigrants.

The Trump administration has sought to strip the cities' Housing and Urban Development (HUD) grants due to their lack of cooperation with immigration authorities.

More than 30 cities from Albuquerque to Boston were under the ruling -- which amounts to hundreds of millions of dollars in grants.

The Trump administration has been increasing its efforts to have so-called "sanctuary cities" cooperate with the federal government.

In January, the Trump administration impounded funding to 34 sanctuary cities. In Chicago, $2.5 million in federal funds for crime victim programs was frozen. In D.C., $1 billion was withheld that would be used for crime fighting efforts.

A judge ruled against Trump's freezing of funds that have already been appropriated by Congress.
  • Impoundment Control Act of 1974: This law restricts a president's ability to withhold funds. It requires the president to notify Congress before delaying or canceling spending.
The Trump administration argued that the Impoundment Control Act is unconstitutional and that the president has the authority to impound funds.

What if Trump simply ignores the order?

He doesn't recognize any power greater than his.

Telling him to do something does no good.

The only way he is going to do anything he doesn't want to do is if he is literally forced to do it.

IMHO, the judge made the right call. Otherwise, the POTUS would essentially acquire a ‘line item veto’ power over annual spending authorized and directed by congress.

The FY 2026 federal “budget” bills are due to passed soon (before October 1?). Will congress come to Trump’s aid and (partially?) ‘defund’ grants to ‘sanctuary’ states/cities?

I would sincerely like it to be legal to withhold federal funds from sanctuary cities, but it's probably not.
Why would you want this?

The issue of whether the Impoundment Control Act is constitutional was decided during the Nixon Administration. The courts ruled that it was.

The only issue is whether Trump will respect court rulings or ignore them. My guess is that he will ignore them.

In the old America, a president who ignored courts would have faced impeachment, like Nixon. With the emasculation of this Republican controlled Congress, no fear of that exists.

Punishment for helping create an illegal immigration crisis that we're all having to pay for.
We're paying for?
According to a July 2024 report from the Institute on Taxation and Economic Policy (ITEP), undocumented immigrants paid an estimated $96.7 billion in federal, state, and local taxes in 2022. Many undocumented workers contribute payroll taxes to Social Security and Medicare, even though they are ineligible to receive these benefits. This helps to bolster the solvency of these programs. In 2023, undocumented households paid $89.8 billion in federal, state, and local taxes.

Studies comparing crime rates in states like Texas, which track the immigration status of offenders, show that undocumented immigrants have lower arrest and conviction rates than U.S.-born citizens across a range of felony offenses.

As @The Brad Dad said, there is no crisis.

Immigrants have been crossing the borders to pick your vegetables, pack your meat, build your homes and buildings for decades. These immigrants commit crime at a lower rate than native born Americans. The right side of the public has been propagandized into thinking that there is a crisis, when none exists.

Apart from the harshness and immoral treatment, the real crisis happens when immigrants are deported, as we are experiencing crops rotting on the vines; construction companies unable to fill vacancies; nursing homes are losing aides, etc.

After more than a decade of being groomed, MAGA have brought us to the training stage. Troops on city streets have nothing to do with crime. ICE, though certainly performing its "duties," is much the same.

All the construction sites around the area are still in progress. The farms in Douglas County and Fallon are harvesting their crops. The hotels are not only still fully staffed, but filling up.

Lombardo ceded control of the Nevada NG to Trump. I have no idea why. Las Vegas and Reno are certainly not crime free, but the crime, in Reno at least, is much different than the crime in Chicago. Gangs exist, but their presence is in the background. There is very little gang violence to speak of. There are a number of shootings, but they are each individual cases with various motives, victims and acts. There is nothing I can see for the NG to do. What saved lives at the Grand Sierra mass shooting were the lightening quick response from police, the knowledge, experience and competence of the security team, and the heroic actions of a brave valet. The NG could not have prevented any of this. Indeed, Reno PD were on the scene in 2 1/2 minutes. That's how you save lives. The NG would have gotten in the way.

Anyway, to make a long post longer, ICE has already been involved with arresting those with criminal records. Nothing drastic, but enough to make the local news. The feds know where the construction sites, farms and hotels are. They know many illegal immigrants can be found in these places. Yet, business goes on.

It's not about crime, and even ICE is mostly for show. What we're seeing is an exercise in desensitization, as many have mentioned, and we're now in the training stage. It will work if not stopped. People will become desensitized to troops on the streets. They will go about their day, ignoring the armed men as they ignore everything else they see daily in their city.

DC has a lower homicide rate than many other cities, that face no National Guard troops.
