The problem is that the SOTH will get away with this because the votes are not there to take his gavel.
Not following exactly what Johnson is "getting away with"??
The House is not in session. There are no bills being being voted on. The status of Adilta Grijalva's seat is having zero impact on anything.
If Speaker Johnson tries to delay the swearing in of Grijalva after the HoR reconvenes then there will be a genuine reason for outrage. I get that. And will join in on the slamming of Johnson. But for the moment there is nothing nefarious going on.
Procedurally the standard is to seat her when Congress comes back into session. Which is what is Johnson said he would do.
