If Biden's 100 Employee OSHA Mandate fails Constitutional Muster

Do those who have already been forced to take the vaccine against their will have legal justification to bring law suits against their employer? Especially those who have documentation showing their request for exemption was denied so they took the jab to save thier jobs?

I would think so.

No reason to believe it will fail.
There is a long legal history of the courts upholding employers right to set conditions of employment, vaccinations being one of those conditions.

Figure out why it was ruled against, amend the next rule to account for that, issue another mandate.

One could rightfully argue the employer only issued the mandate under the direction of the Federal Government pending law that was ruled UC.

Nobody has been forced “against their will” to be vaccinated. They chose to be vaccinated rather than losing their jobs.

Some idiots very likely will attempt to sue their employer, and they will very likely fail.
 
It was generous of me to use the word ‘if’ knowing good and well Biden’s Soviet style tactics on Americans will not be tolerated.

Not my employer. They issued a mandate long before Biden did because they are not stupid. They want us all vaccinated and safe.

So one would not "rightfully argue" that.

All the far right SC basically said was that the government could not mandate it.
Individual companies can indeed mandate themselves that all employees are vaccinated.
And increasingly companies are doing just that.

Why would a company want their employee base to be vaccinated, healthy, and able to work at no cost to them?

And companies are required to provide a safe workplace for their employees.

If employers can mandate vaccines, then they should be liable for lawsuits if the person develops a condition from the jab to keep their job.

Fair?

Should employers also be responsible to not taking precautions and employees getting sick?
