The only reason this "shutdown" could occur is because of an agreement that such funding and other critical bills will be passed with 60 votes.

But that is just an agreement, which can be voided by reverting to a simple majority vote. I.e. "The Nuclear Option."

There are 53 Republican Senators, and 1 Democrat Senator (Fetterman) who voted aye. Leaving 46 Democrat Senators voting nay.
