Federal judge blocks Trump administration from barring foreign student enrollment at Harvard

You are so willing to lie to justify sweeping government attacks on educational institutions and free speech.

Because like most other things with you Trumpists, it’s a pretext only.

The goal is complete control over these institutions.
The goal is to hurt these people because they dont agree with their world view. Maga has changed the social contract

Go to the District Court and tell them they have no right to rule on violations of the Constitution. You would sound like one of those Sovereign Citizens swearing the Government doesn’t have the Authority over him.

That is not what I said.
I said Congress has the power to create and define the jurisdiction of the courts.
And with respect to immigration, Congress has sharply limited Article III power in it.

Right. So, what else is new?

This judicial activism and opposition was planned way before Trump won his election.
As was Trump’s lawbreaking.

So the issue then is 'Who decides.'
Not you and not Rubio.
Rubio can make the claim sure, but you take it to court and provide due process and sort out the facts.

You know what America was ****ing built on. Not this warped power bullshit you are spinning

Sure-- immigration court.
Which is under the authority of the Executive Branch.

You posts are positively other worldly.

That's a decision that the law leaves up to the Sec of State.
Nope. There has to be cause. He can’t arbitrarily revoke their visas.
Not the courts.
Specifically the courts, as it requires due process.

It’s why Trump keeps having his ass handed to him in court. And why no Harvard students visa has been revoked, and why Harvard’s certification remains in tact.

Please, for the love of god, take a basic 6th grade civics class.

No they haven’t.

It's not a change in the social contract but rather a dissolution of it.

He might be involved is some, but it's not just him.

Here's what Copilot says...

who is paying for all the lawsuits against the trump administration
The funding for lawsuits against the Trump administration comes from various sources, including state governments, cities, nonprofit organizations, and private entities. For example, Denver has joined lawsuits challenging federal funding cuts, and multiple states have sued over budget freezes2. Additionally, universities like Harvard have filed lawsuits over revoked federal funding.
Many of these legal challenges are backed by advocacy groups and legal organizations that raise funds through donations and grants. Some lawsuits are also supported by congressional appropriations meant to reimburse cities for costs incurred due to federal policies

Here are a couple articles on the subject...

As I said, this was planned.
The felon is a wannabe dictator. And the MAGATS have no problem with that.
Disgusting

I see. I was wrong then

Only partially.

The Immigration Courts were created by Congress and placed administratively under the Executive Branch for administrative purposes.

Congress still controls the rules under which Immigration Judges operate, not the President in a unitary fashion.

I said Congress has the power to create and define the jurisdiction of the courts.
And with respect to immigration, Congress has sharply limited Article III power in it.

And the Courts have said those laws are not applicable.

Let’s take an easy case. Abrego Garcia. The Immigration Court which is not a Judicial Court said he could be deported. The District Court, which is Judicial, said he could not. The Judicial Court issued an order that Abrego Garcia was not to be deported.

Trump and the Fanboys have argued extensively that the Immigration Court had the proper Jurisdiction and the Judicial Court had no such Jurisdiction. The Courts at every level said the District Court had Jurisdiction including the Supremes.

Trump thumbed his nose at the Supremes and said he had no power to return Abrego Garcia. The Supremes in a subsequent case said that nobody else could be sent to CECOT in El Salvador since the Administration was unable to rectify a mistake in deporting Abrego Garcia.

Immigration Courts are not part of the Judicial Branch. That is why warrants from the Immigration Courts are called Administrative Warrants.

I see. I was wrong then

Don’t sweat it. The Trump Fanboy Propaganda keeps harping on the Immigration Courts as if they are part of the Judicial Branch.

The easiest way to see it as sort of like the Bankruptcy Courts. Very limited power and they must abide by Judicial Court Orders in their judgements and actions.

Close but I think some clarification is in order.

In 2019 the Immigration Court said he could be deported, but then placed a "withholding" on deportation because he couldn't be deported to his home country. The hold was pending further action which the Trump Administration didn't pursue. That being action under 8 USC 1231 which would be find a 3rd country that would accept him. Then returning to the court file a motion to lift the hold.

The Federal Court did not rule that Abrego Garcia couldn't be deported, it ruled that he couldn't be deported without Due Process to challenge his deportation back to his home country which the Immigration Judge had blocked and without Due Process to challenge the grounds the government used (i.e. the AEA) and his inclusion in the targeted groups in the proclamation (one being he's not Venezuelan and second not being part of the identified gang).

The Immigration Judge dealt with deportability, the Federal Judge is dealing with Due Process.

This is not about the expectation of privacy of individual students. It's about Harvard's expectation of privacy on its private property as a private university. Harvard is not a public street. Universities have their own private security cops.

The notion that mere protest against the right wing government policy in Israel under Netanyahu is anti-semitism is absurd. There are left-wing American Jews who participated in those protests.
If Harvard cannot prevent violence or arrest or charge those that commit or fail to protect the targets of that violence it is no longer about Harvard being private but that they have failed, and government has to step in to protect Jewish students. Put another way Harvard's privacy is built on an understanding of their responsibility to all of their students; they failed at that.

What is absurd is you ignoring obvious violence against Jewish students, not because they support any policy, but just because they are Jewish.
