Sure. Why not?

While prosecutors declined to comment on the video of the family, U.S. Attorney Adam Gordon for the Southern District of California and other officials sent a warning to cartel members, repeatedly citing the Sinaloa Cartel by name.

“Let me be direct, to the leaders of the Sinaloa Cartel, you are no longer the hunters, you are the hunted. You will be betrayed by your friends, you will be hounded by your enemies, and you will ultimately find yourself and your face here in a courtroom in the Southern District of California,” Gordon said.

 
Possibly, but it depends on the circumstances.

Also, it may be important to remember that our founding fathers (the US) could have been considered terrorists had we not won the revolutionary war (I know they should be capitalized but my "r" on my keyboard is still having issues). Especially those who were involved in terrorizing Tories, many of which themselves ended up fleeing to Canada. At the same time, it isn't inconceivable that some Tories themselves would have been labeled as terrorists had they or even their family been working to spy on "the rebels" or even actually to sabotage the war efforts themselves. Family could get caught up in such accusations with guilt by association and have no choice to avoid being persecuted and possibly even prosecuted for what their family members may have done.
