No actually they do not. That is why we have laws governing the sentencing of criminals. For instance murder in the first degree is guaranteed to put someone in prison for a minimum of 25 years to life in most states or the death penalty.

I believe that you are confusing mitigating factors with aggravating factors. A first time offender with no aggravating factors will often get a smaller sentence than someone with the same crime and aggravating factors. Again, based on law.

Deportation is not punishment, sending the children with their parents is not punishment. SMFH

Sending someone away from the only place he's ever known and throwing him into a country and culture he's completely unfamiliar with. Tearing him away from friends, possibly family, his job or school, etc. Sure sounds like punishment to me.

DACA is also based on law and is the law of the land until over turned
 
So deporting the parents while leaving them (the children) here does what? What do we do with those who are under 18?

If they're young kids just send them back, they'll have time to adjust before becoming adults. If they're older, say 15 and up, let them decide if they want to stay or go back with their parents. If they decide to stay, they become a ward of the state for a few years.

It can also be considered as a new experience. People move all the time. Even to new countries.

Tell me, do you consider it a punishment for parents to tear their children away from their friends and everything they are familiar with when they move to a new location?

Note: This is coming from someone who's parents did this very thing through out my childhood. I know what its like.

That's a lot of assumptions in one sentence. I'm pretty sure most of them know and remember where they came from. They live in their culture at home, no different then they would in any other country. People move all the time, this would be no different.

It's not the law of the land, it is merely an EO that can be changed with the stroke of a pen. If the admin fails to use that pen, there are a number of governors that will be taking it to court, just like they did DAPA, where it was found unconstitutional along with DACA 2.0.

When people move they have the option to leave their children with family if they feel it is in the best interest of the children. This is no different
