Divorce man 'wants kidney back'

A US man divorcing his wife is demanding that she return the kidney he donated to her or pay him $1.5m (£1m) in compensation.

Dr Richard Batista told reporters that he decided to go public because he was frustrated at the slow pace of divorce negotiations with his estranged wife.

He said he had not only given his heart to his wife, Dawnell, but donated his kidney to save her life.

But divorce lawyers say a donated organ is not a marital asset to be divided.

Dr Batista married Dawnell in 1990 and donated the kidney to her in 2001. She filed for divorce in 2005 and a settlement has still not been reached.

Dr Batista's lawyer, Dominic Barbara, said his client was "asking for the value of the kidney" that he gave his wife.

I saw this last nite.

He values his kidney at 1.5 million dollars. :shock:
 
I feel sorry for the guy. I mean, he gave her a kidney, for crying out loud, then she cheated on him and filed for divorce.

Still, you can't go around reclaiming body parts. Cheating is not a capital offense. Nor can you demand payment for said body parts; that's illegal.

So as amusing as this scenario is, it's destined to go nowhere legally.
 
He should demand his brain back, which he lost when he asked her to marry him.
 
Anyone wanna start a poll on what happens after this guy loses?

I put my imaginary 5 bucks into him capturing her with chlorophorm(sp?) removing the kidney and leaving her in a cruddy hotel room in a bath-o-ice.

She is a punk. It's one thing to file for divorce, it's another to go off and cheat on him. I hope she receives public scrutiny. I think the ex is just enraged and not thinking clearly. I'm sure his $$ lawyer is making it all sound reasonable, when just in fact it's not.

It is pretty unfortunate that she just so happens to have his kidney. I do not think the kidney has anything to do with the relationship. He is just making it seem as if he gave the kidney to her in hopes that she would forever be in love with him... I smell a good "based on a true story" horror novel coming out of this... what if he wanted his kidney back and couldn't rely on the law to get it.

I agree. I feel very sorry for the poor fellow. I mean, she was bedhopping less than 18 months after she'd harvasted his organ! That's cold.
 
donating an organ has to be a gift with no strings attached - including fidelity.

the idea that she owes him a faithful marriage for it is ludicrous.
 
IF he should be granted a monetary amount in this case? Could that then set a legal precedence where you can sell your organs? :shock:

Ahhh...no.
He gave an organ and as he said, after he donated his organ she should not have been accepting organ donations from other men.

He's getting value from this exercise far in excess of the return of the organ or cash. She is being publicly humiliated.
 

She has a story to tell, too. She says she never cheated on him and that she just as easily could have gotten her brother's kidney. He wanted to be her donor.

If he has visitation rights then he has to protect those rights. Seeing his kids is really all he wants.

Problem is he donated the wrong organ for fidelity. I have been donating an organ to my wife several times a week for almost 40 years, and our marriage is strong. :mrgreen:

Well, if nothing else, it's encouraging at least to see an organ recipient leading such a full and active life.

:shrug:

When organ recipients are feeling well enough to be assholes, rather than lying around being helpless invalids, we must be making progress.
