If it were the DC Court Obama might be in trouble. But, we'll have to keep and eye on it anyway.

I don't see this going anywhere. Its painfully obvious that the Judge abused his authority so he could throw his two-cents in on a completely unrelated issue from the case he was supposed to be deciding. Homeland Security told the Court that the defendant was unlawfully present in the United States and the defendant plead guilty to unlawful re-entry. He was ready to take his lumps and neither side said anything about this executive action until the Judge ordered the Government and Defendant's counsel to submit arguments about it and invited amicus briefs to do the same.

And constitutional chaos at it's finest. This is completely absurd. Not only is he basically trying to grant the executive branch more power than it already has, he's completely corrupting our checks & balances system. He's like an impulsive child not thinking about the consequences of his actions.

That case isn't going anywhere. Its completely unrelated to the lawsuits challenging the executive action. This was just a judge who asserted his opinion on an issue completely unrelated to the case he was deciding.

I agree that it may be a tough decision, but bear in mind that this is a deeply Conservative SCOTUS that believes in a very strict interpretation of the Constitution. This lawsuit might possibly prevail.
Except when they don't, like with Obamacare.

Once again, I believe that Roberts will be the swing vote here, but understand, the premise is different with this case. Here they must decide if Obama, as head of the executive branch of government, is required to faithfully execute the laws of the land to the best of his ability.

This wasn't a lawsuit. This was a judge overstepping his authority at a sentencing hearing to create an entirely new case out of thin air. I suspect thats how it will be treated.

The suit he was deciding on involved prosecution and deportation of an illegal immigrant. A projected amnesty executive order WOULD bear on the case he was deciding on...if such order exists. Think of it along the lines of a judge deciding on a speeding ticket when the governor of a state has just declared there be no more enforcement of speeding tickets.
