Did Trump really declassify all the documents in his possession?

It's not mentioned in the Trump team's 8/31 court filing. Perhaps because he never declassified anything? Perhaps because there are some documents that a President can't declassify?

At this point how would anyone know? The photo today shows a bunch of cover sheets and redacted documents.
 
Nope....if you were anyone other than the President, yes, because the President is the classifying authority on it. Those regulations are for everyone beneath that office, so far as their binding authority.

And "everyone beneath that office" is obligated to treat a given document as of it's last known status. Ergo, the document is still classified until Trump informs someone "beneath that office" otherwise. "Everyone beneath that office" is trained on how to identify and handle documents based on their last known status. If it were otherwise, "everyone beneath that office" would have to personally check with the president every time they came into contact with a document, classified or not.

This thread isn't about the photo. It's about the Trump team's response to the DOJ's filing about the special master request. It was filed this evening. it doesn't mention that Trump declassified any of the documents found out MAL.

And as Bluetex noted in post 2, Trump's lawyers specify the clearance level that the special master will need to look at the documents. If the documents were declassified, why would the special master need security clearance?

Declassifying sensitive information to try and save his own ass is just as disqualifying as not declassifying it and leaving it lying around his spy-infested country club. Either scenario is abhorrent.

Of course, Trump did not declassify the government owned documents/materials seized from Mar-a-Lago.

There has been zero evidence submitted that proves otherwise.

In fact, it is impossible for Trump to prove any legal justification for having the documents/materials.
 
It would be very irresponsible to do but it's technically within the power of the presidency. There are lots of things that can be done that shouldn't.

Unfortunately for him, that wouldn’t mean shit if he is prosecuted for violating the Espionage Act.

Which is exactly why Trump belongs nowhere near the oval office. The constitution was written with the expectation that men of character would hold the office. You know, those who would protect and defend the constitution not the guy who will ignore it or misconstrue it just to achieve his agenda.

It's not that he couldn't have declassified them, but that requires more than just declassifying them in his mind. Probably requires notifying NARA, and doing it while he still was President. After Biden became POTUS he couldn't declassify shit.

Well, that line of defense is now moot because Trump has now admitted that documents seized at MAL were in fact classified. And, he says, it's no big deal. Because . . . he was president at the time the stuff got to MAL.

New line of defense. And . . . GO!

I think that if he wants prove his case he would have to have told other people, and I don't think he did what he claimed. I never said he actually did it. People have a difficult ****ing time reading. The only thing I have ever stated, and it's a fact, is that the President has the ability to do so.

By Trump's reasoning of ultimate authority he could have started to execute his distractors as well, their argument doesn't hold up.
