Did the DC judge who is overseeing the Trump January 6th trial outsmart Trump?

Lib-progs would call the sense of comfort we feel from our blind obedience and lack of discernment liberating, but that word doesn't exist in our lexicon. We'd call it loyalty or allegiance or devotion instead: Faith.

I've been reading the discussions around this community about this upcoming trial and all that is going on, but have to stay away from most discussions, as there is so much mob style posting going on and nasty (impolite) language. I'm too delicate to be able to handle such tough humans.

BUT I was paying attention when I saw reports about this judge's errors in the past. That went into my notes. I haven't had time to get the details, but I will try and find time.

I also put in my notes that maybe this judge was sort of into a personal situation of personally wanting to show herself she is independent from Trump and had in my notes to explore that, but that is a tough one and would take time to study.

The one note that worries me is if she is being set up and knows it and secretly agreed to it, or is accidentally getting into a set up. Have the trial, but make mistakes and the whole thing gets tossed. She may not realize she is in a set up. She may know it. I haven't come close to studying that thought, but it is in my notes.

Those are just some notes I have for myself and for study, when time permits.

Overall, this is one messy situation. It certainly is not cut and dried as so many seem to think. There are so many factors involved it is amazing. Just to document all that has been going on over the past few years in the United States would almost require a very big building just for the sole purpose of archiving everything. And even defining "everything" is a daunting task.

But there is nothing about this that sits on a solid piece of stone. This is built on some sort of wooden platform and is exposed to the elements. And is in danger of damage or destruction by human hands in many ways and at any time. Kind of hard to realize that so soon we have gone from Watergate to this.

Outsmarting Trump in legal matters is nothing the Judge would be proud of. Trump's record of success v failure is mainly all failure.

However I do think the Judge surprised Trump and his legal team in setting the boundaries of her penalties outside what Trump's attorneys would have expected but inside her purview.

Cultist is an apt description considering that Americans have been convinced to love a man who tried to overthrow our entire electoral process.
 
And then there's jury nullification where any one juror can willfully and unabashedly disregard the evidence and the law as explained by the judge and find the defendant either guilty or not guilty based only on their whim. And, guess what, if that juror did not perjure themselve or operated based on a bribe, etc, there's not a damn thing that can be done about it.
That's the general theory of vire dire. Now ask yourself how impactful those judicial admonitions will be in a criminal trial involving the most divisive American man in this century
Yes, that is a possibility, but if we are to strengthen our institutions which have been so damaged by years of undermining belief in our system of law and government, we have to do all we can to restore confidence in the ability of those institutions to perform their functions. Failure to support those processes is what was used to inflame the mob that attacked the Capitol. I don't want to be a part of eroding what we have left. I have to hope that the court can weed out those who would betray our country that way. It's pretty obvious to me when reporters interview those who participated in the events of January 6 who those people are. If I can see it, those experienced prosecutors in the DC Court certainly can.

Now, Cannon's court is another story, but perhaps the Federalist Society is ready to throw Trump under the bus considering the move to justify removing him from the ballot. Apparently, he's causing them more trouble than he's worth.

One was he would try and step up to the line and try not to go over it so he could tell his cult members, see Ican do this and she cannot stop me as I have first amendment rights. The other thought was more like Trump, he would step well over the line and then dare the judge to do anything about it, meaning jail him. The judge did not fall into either trap, she just said that if Trump ws Trump and tried to get around or go through her order, she would just bring the date for the trial up sooner, something that Trump really does not want. NO jail, just a rial months sooner and even before the date suggested by the prosecution. So if Trump does what he suggested he would do, we could end up having the trial before he end of the year, all because of Trump.


Yes I thought that was smart of her.

She definitely did outsmart trump but that really isn't that hard to do.

I think you are confusing judges. Which isn't hard to do, there are several cases happening all with different judges, prosecutors and lawyers.

The judge who made mistakes is the one in Florida. She was appointed by trump.

The judge that made the ruling yesterday is the one in DC. She wasn't appointed by trump.
 
Looks like I've made a very stupid error and thank you for pointing that out to me. AND I guess I wasn't aware that the documents case was not about January 6th. There's no good excuse, but I have been juggling a lot of items and have not been as good at filing my notes and keeping things in proper order as I was before my constant medical stuff started.

No it wasn't stupid. It was a very easy mistake.

There are several trump trials happening now. All in different states.

It's very easy to get them mixed up.
 
I won't use a quote box this time, but the words I just read "taint the jury pool" written by RaleBulgarian really has me wondering something.

How could any member of any jury in any courtroom handling issues related to Trump not have read, heard, maybe discussed matters related to all this before they got the notice to serve on a jury?

I mean, if you could actually find a sane citizen of the U.S. that has not one bit of knowledge about all this stuff, wouldn't alarm bells go off? It's been going on for a long time; it has been in the media for a long time; it is dining room table talk for a long time, maybe the mess hall at work or whatever that eating place at the factory, or company is called.

Just how in the heck are the legal folks going to find anyone who has no opinion on so many issues related to this?

And if they seriously know nothing and/or have no opinion, are you going to trust their ability to understand what will be happening at the trial?

Just finding a jury is going to take a very long time, I think.


They can't and won't look for people who haven't heard or read about this.

What they will do is find people who honestly can be impartial.

It's been done before with other high profile cases.

It is the deplorable, MAGAt, cult members who condone Trump’s vile acts that tend to be the most reprehensible

Just so we're all clear, Judge Chutkan could do both. She could move the trial up sooner, and she could revoke his bail until the completion of the trial. She probably won't, but she could.
