Finally, the worst supreme court appointment in my memory is going. George W. Bush has lived to regret his choice for almost 19 years. Good riddance, Judge Souter.

But now what comes next? What kind of wacko will Obama appoint. The person will undoubtedly be a liberal, but so was Souter. Age is a key factor since the younger the person, the longer their tenure on the court.

But can time work to Obama's disadvantage? A number of judges have flipped and now vote other than it was originally thought they would. Can Roberts, Scalia and company wear them down with logic? Will the new appointee change over time?

Any opinions, informed or otherwise here?

Have you ever read a Scalia opinion?

Scalia is widely known for writing the most convulted opinions there are.

When you read an opinion (without looking who authored it)...if it sounds like the person decided what they wanted to decide and then went back and tried to write an opinion to justify what they decided....you can guess "Scalia"..and about 99% of the time...you'll be right.

From what I have read, it was Thomas who pushed Scalia further to the right. Its just that the writing of opinions do not go to Thomas because he is too extreme.

Also, from what I know, Scalia does not wear anyone down with logic, he actually pushes other Conservative members further to the left. His belittling of O'Connor has been blamed for making her a more liberal justice, along with Souter and Kennedy.

Thomas doesn't author opinions because he isn't capable of forming an opinion without first looking to see what Scalia writes.

No doubt he pays too much attention to pesky things like original meaning, the rule of law, constitutions, strict construction and such.
