Assault with deadly sandwich

Well as @Airyaman posted above, he's already been to the DC Superior Court where the Judge all but dismissed the charges.


So they refiled in Federal Court, and there the Judge released Dunn on his own recognizance, not even Bail, agreeing that this appears to be an overcharged case.

While your read of the Law may not allow context, the reality is that Justice does. But let's pretend that they convince the Judge to go forward. Do you really think that twelve Jurors from the District are going to say yeah, he's guilty of a Felony for this?

The letter of the law is the starting point. From there court cases including cases decided by the Supreme Court define the laws. Those cases are called Precedent. A big part of that is the principle of Reasonable Application of the law.

The Judges are aware that this is overcharged. When they didn't get the desired outcome in District Court, they ran to Federal Court and got nearly the same response.

I live in Rural Georgia, and you could make up a Jury of any twelve of my neighbors, and you still couldn't get a conviction for a Felony for throwing a sandwich as a Felony. If anything my neighbors would be annoyed that the Court was wasting their time.
 
He knew he was going to get fired at least. Probably doesn't want to work for this DOJ. What decent human would?

I think this whole thing got blown way out of proportion.

The case needs to be dropped.

Honestly the only way this goes to trial is if they get a Trump Appointee for the Judge, and promise him an Appeals Court slot. Even then the odds of a Conviction are lower than Trump telling the truth for eight consecutive seconds.

Good for her! That is likely how most MAGATS et al probably see her, as a Guatemalan first, then maybe as an American.

It's likely to be reduced, in the end it was just a sandwich. But can't be throwing things, even sandwiches, at the police. So there will be some repercussions.
 
I haven't been to Subway in years so I cannot estimate the deadliness of such a weapon.

First, I am tickled that a librul used Fox News as a source. (y) It was a costly assault. Besides the assault rap, he outted himself as part of the deep state and lost a very high paying job.

I tend to avoid all the big chain sandwich shops. They buy cheap ingredients in bulk and pre-slice the meat before it ever arrives at location. Find a good local independent.

Dunn certainly deserves to be penalized, including losing his DOJ job.

You are just wildly guessing. It is being prosecuted as a felony. And it is an open and shut case. The only question is how much punishment. That it was a sandwich and not a gun, I doubt he will get the minimum 2 years behind bars. However he will likely get jail time and have a felony on his record, which will likely preventing him from getting government employment in the future.

The government will have to prove in front of a jury that there was an intent to cause bodily harm with a sandwich and that act is worth locking a person away for years.

The sandwiches are fine. They just cranked the price into the **** that zone. It's not worth eight or nine bucks for a six inch most of the time; maybe as a special treat or a nostalgia thing, since I used to eat there a lot.
 
What do you think a judge is (or should be) empowered to do with a charge that you don't like but 100% meets the elements of a crime, without question?

imo, The crime meets some misdemeanor charge of simple assault.

Well, he was assaulted, with physical contact, while performing his official duties. This isn't some 12-factor test. Which element do you think ISN'T met?
