Arizona AG says state can cite ‘invasion’ to deport migrants without feds

Arizona's AG has made a legal determination that it's being invaded and will bypass Biden who has opened the border to illegals. The governor is dragging his heels on this but public opinion will force him to do the right thing. Texas will likely do the same and soon all of Biden's illegals will have to funnel through California.



"Arizona Attorney General Mark Brnovich claims in a new legal opinion that Republican Gov. Doug Ducey can declare the Grand Canyon State to be under “invasion” in order to begin deporting suspected illegal immigrants — but Ducey appears reluctant to do so.

The approach would theoretically allow Arizona to break with the Biden administration and start turning away people at the US-Mexico border, where officials made approximately 1.9 million arrests last year."

Tucson, for example, is not a sanctuary city, but it will also not do the work of the CBP, nor allow the CBP to use their facilities.

Sure they can.. we are in Texas... The problem of course is they can't build on FEDERAL property without the approval of the federal government... Same with private property without using state eminent domain powers which would very likely fail...

Except those powers do not permit the federal government to force state officials to enforce federal law. It's been addressed in the courts.

A so-called "sanctuary city" cannot lawfully block federal law enforcement from coming in to sweep up illegals and criminals, but it can lawfully say "nah, I'm not doing that. You can." to the feds.

And there are valid reasons. For example, it's been found that witnesses to and victims of crime don't come forward because ICE watches court cases, and will send people to haul them away as they leave the courthouse. As between someone committing the federal civil infraction of being unlawfully present and someone who did an armed robbery or murder, I want arrest of the latter prioritized. I don't want to see violent criminals getting away scot free simply because witnesses/victims won't cooperate.

Also correct. Although the example I gave was Tucson, which has stated that it is not a sanctuary city, but rather a city which will not assist or cooperate with federal immigration officials.
