nov 9 2015 NEW ORLEANS (AP) — President Barack Obama's plan to protect from deportation an estimated 5 million people living in the United States illegally has suffered another setback in court.

In a 2-1 decision, the 5th U.S. Circuit Court of Appeals in New Orleans upheld a Texas-based judge's injunction blocking the Obama administration's immigration initiative.

Republicans had criticized the plan as an illegal executive overreach when Obama announced it last November. Twenty-six states challenged the plan in court.

I can't believe that the Obama Admin actually argued that States had no standing to challenge Obama's EO's regarding a case that is about millions of people inside their own borders.

Obozo says his amnesty is a form of "prosecutorial discretion" and that is absurd. Sometimes criminals are not prosecuted for PAST crimes but i don't know of any case where the govt gave anyone a certificate saying they could break our laws in the future!!!! And obama wants to give this certificate to 5 million - actually it will be more like 40 million.

This is way way beyond prosecutorial discretion.

The fifth circuit is the most conservative in the country, this was an expected defeat. My understanding was that once the suit was filed the administration maneuvered to have the case heard as quickly as possible in order to get the disposition they expected so that they could file an appeal to the Supreme Court before President Obama left office. Barring a change to that plan it seems likely that this will only be resolved by the Supreme Court, and yes then we will be bound by the courts. I only hope you are as sanguine about that when a final judgment is rendered as you are right now.

He won't file an appeal with the Supreme Court. They wouldn't accept it and if they did he would lose. That is why he didn't file an appeal on the case prior to this so he went to court with a new case. It didn't work because he doesn't have a case.

They have already signaled their intent to appeal to the Supreme Court.
