Fox News GOP Debate - 9pm EST

The common law is partially made up of judicial interpretations, constructions, limitations, etc. of the law. You'll find it with conservative judges, liberal judges, libertarian judges and moderate judges. It's a constant. And it's law created by judges, some times informed by statutes, some...

Fox News GOP Debate - 9pm EST

The idea that courts don't create laws is a myth that won't die. Of course they do, that's what the common law is for God's sake. Interpretations of vague language has the effect of the creation of new law. That's just reality.

Arizona sheriff faces federal allegations of discrimination against Latinos

It should be interesting to see what comes of this. God knows Arpaio will use this to strengthen his 'there all against me' rallying cry, but I'm curious as to how the DOJ will follow up with this.

BO wants to run a Big Government campaign......good luck champ.

The OP's poll would be more salient to me if I had any confidence that the American public could tell me what 'big government' means.

    Yo (Part II)

Heh, between this and and your avatar, I've gotta do it: Damn. I'm originally from Jersey but have lived in New England most of my life...but I'm a Jets fan. The Jets, the Bruins and NU hockey; if baseball were never played again, I'd be okay with it.

    Yo (Part II)

Hey All, I started posting here a year back and have been gone for a bit, and now I'm back. Because I'm certain no one remembers me: I'm NortheastCynic, 23, mixed-race, pride of Boston, MA and a current law student. I'm a pragmatic, liberal kind of guy and my main areas of interest are civil...

    Why They're Wild About Palin

For a 40+ year old...I guess. In order, yes, no and on her inability to routinely state things that are true. Whether it be her inability to name a single SCOTUS case other than Roe, the 'I can see Russia from my house' remark, her constant struggle with the English language, her blatant...

    Why They're Wild About Palin

I'm still struggling to determine just what it is about Palin that conservatives (some) find so attractive. Not overly bright, not overly politically adept and not overly experienced. What has she done that has made her as popular as she is?

Giuliani to decided in 30 to 60 days if he will run for Governor

Giuliani's audacious intellectual dishonesty during the Presidential Primary Debates a year and change back contributed to my losing almost all of my respect for him. That said, given New York's current crop of gubernatorial 'could-bes', I'm fairly certain whoever wins the nomination will be...

    $10B aimed at union retirees

How is it that whenever a union or an industry is given taxpayer money it is declared by some to be good for 'American workers'? As if the forfeiture of money from a man or woman working at CVS to a man or woman who used to work for GM benefits both people. Absurd. -NC

The me-first, screw everyone else crowd

Could it be possible that fiscal discipline doesn't just benefit those who would like to keep more of their paycheck? Fiscal discipline (lower taxes, reduced spending) aides the overall fiscal health of the country, not just the overall fiscal health of 'the wealthy'. It is a false dichotomy...

    Sotomayor sworn in

Summa cum laude from Princeton and law review editor at Yale Law school and a great rating from the ABA. She's as qualified as one can be. Now, I know that about 50% of her rulings will bother me and her comment regarding a 'wise Latina' was unspeakably stupid, but she is quite qualified. As...
