A migrant from Guatemala has been arrested for allegedly lighting a sleeping subway rider on fire in Brooklyn on Sunday morning — then watching as his innocent victim burned to death in what the New York’s top cop called “one of the most depraved crimes one person could possibly commit.”
The savage killing — which happened at about 7:30 a.m. on an idling F train at the Coney Island-Stillwell Avenue station — shocked commuters, MTA workers and NYPD Commissioner Jessica Tisch, who said Sunday that the heinous crime “took the life of an innocent New Yorker.”

Comment:
Why has this not been called a hate crime?
Is it because the race of the victim and the race of the suspect does not fit the radical left's stereotyping?
Are they trying to protect the suspect?
If the races were reversed, would it be called a hate crime?

Have you tried making a list of the elements necessary for a crime to qualify as a hate crime

and then making an inventory of the elements in this crime

and then comparing the lists to see if all the necessary elements exist in this crime?

it was not a robbery
it was not a rape
it was a hate crime

the question is; why hasn't the suspect been charged with a hate crime

I meant for you to make an inventory the legal elements which must be present in a crime in order for the crime to qualify as a hate crime.

Different crimes require that certain events occur or that certain conditions be present.

For example, the difference between the crime manslaughter and the crime murder can be the presence of certain
legal elements.

A homicide where the perpetrator had some malice aforethought might qualify as a murder.

Whereas a homicide which was less intentional might lack enough legal elements to qualify as a murder but might still qualify as manslaughter.


So start by picking a jurisdiction, like New York.

Then find out which statute in New York lists the elements necessary for a crime to be a hate crime.

Then use that list in the New York law as your list of elements necessary for a crime to be a hate crime.

You need to read up on what constitutes a 'hate crime' in Brooklyn and what elements need to be proven beyond a reasonable doubt to get that 'enhancement' added to the sentencing guidelines. Then you need to find out if the prosecution's case can support that evidentiary burden. Personally, I would wait longer than a nanosecond passed arest to pass judgement. The DA's office may be looking at hate crime status as we type.

You might get more support for your position if you answered the following: What is the legal definition of a hate crime in the jurisdiction where this occurred? How do elements of this crime fit the definition?
