Why America needs a good spanking.

This would not a frivolous lawsuit at all.

She was walking in an area designed for pedestrian traffic, which means giant holes in the ground aren’t something one would naturally expect.

Leaving such a hazard in an area designed for foot traffic goes beyond basic negligence, someone made an extremely stupid decision and they are lucky she didn’t get seriously hurt from their idiocy.

So it's their fault she walked into a big hole in the ground then?

Yes, they certainly share a large portion of the negligence in this case.

It is not unreasonable to expect that a place specific to pedestrian traffic would not have a big hole in the ground. Would you be equally unsympathetic if it were a blind person? How about a mom pushing a stroller that prevented her from seeing the hole?

blind person wouldn't see the damned sign regardless.
 
yeah, there's supposed to be barriers around open manholes in side walks.

However, the biggest barrier intelligent people have against walking into open manholes in the sidewalk is the fact that they're smart enough to watch where the hell they're putting their feet.

America should be spanked for one reason, and one reason only:

THERE'S NO VIDEO OF THE TURDWARD BOUND BIMBETTE FALLING INTO THE HOLE!

What the hell is the matter with this country, anyway? Can't anyone see a good opportunity anymore?

(Anecdote: When I was a kid, a few of us were walking down the street, and there was enough of us that we overflowed the sidewalk. The one closest to the road was busy looking at us talking, and the rest of us were busy keeping him looking at us talking, because that telephone pole looked really inviting. He only walked into the one obstacle that I know of...)

A blind person has a stick they wave in front of them, and they should be able to find the hole, and they often have a dog, so the blind person should get some warning from the echoes of the dog barking from down the hole.

What, is the damn mom so friggin stupid she doesn't look past the front wheels of the stroller? Or she let's go when it starts to tip in?

I'm not saying these people have no responsibility for what happens to them, but I also recognize some extremely negligence behavior on the other party, which makes such a case far from frivolous....and that was the only point I wish to make.

Hey, a person would have to be pretty stupid to not notice a giant band saw running in the middle of a walkway too, but I think a little fencing off of said unusual object isn't too much to ask of people in a civilized society.

Im blaming the person whos physical action of walking caused the harm.

If you are walking, you should be looking where you are going. If you are not, you and you alone are at fault for running into something.
