With Rosenstein out, Noel Francisco will suddenly be thrust into the position of overseeing special counsel Robert Mueller’s Russia investigation. Justice Department rules state that its No. 3 official, the associate attorney general, would take the post. However, Rachel Brand left that role in February and has yet to be replaced. Thus Solicitor General Francisco would assume command.
Francisco previously served as associate counsel to President George W. Bush from 2001 to 2003 before moving to serve as deputy assistant attorney general in the Office of Legal Counsel. In 2005, he moved into the private sector, joining the law firm Jones Day before being appointed as Deputy Solicitor General by Trump in January 2017. Two months later he was confirmed to the post of Solicitor General by a vote of 50-47 in the Senate.
