US judge tosses machine gun possession case, calls ban unconstitutional

(Reuters) - A federal judge has dismissed charges against a Kansas man for possessing a machine gun, saying prosecutors failed to establish that a federal ban on owning such weapons is constitutional.
The decision by U.S. District Judge John Broomes in Wichita on Wednesday appeared to mark the first time a court has held that banning machine guns is unconstitutional after the conservative-majority U.S. Supreme Court in 2022 issued a landmark ruling that expanded gun rights.


I honestly didn't see that one coming...
 
Our partisan SCOTUS insists there are no limits to firearms.
They also say, to placate people temporarily, that they CAN impose some limits, based on according to them, nothing.
Limited by? According to them, nothing.
Can be undone with another ruling trivially? Sure, because precedent means nothing to them, even though they claim it does when it suits them.
Federalist society sophists, here to push their agenda and not put the Constitution first...

Our SCOTUS has been corrupted, and now it would take an amendment to get firearms under control.

Until then, thoughts and prayers.

I'm surprise but eventually there would come a judge who pushes the firearm laws like some do other MAGA causes. Judge shopping in Texas is a tradition. It will be interesting to see if this 'logic' holds up... ✌️

I figured more like the appeals court will knock this down and while Alito and Thomas might support making full auto the law of the land the rest will probably baulk... ✌️

Because I am a part of the human race, any man's death diminishes me. However, had that shot missed an inch the other way, the pumpkin would have vaporized on national TV. I can't help but believe gun control would be moving ahead. And if he had died from covid, how many more thousands of Americans would be alive?

I don't see anywhere in the Constitution where carrying machine guns is banned. Not that I like the idea of people being able to do so.

Two things.
1. The opposition apparently didn't make their case.
2. The 2nd amendment supports gun ownership and doesn't list any restrictions. So to get a restriction the case would have to be well defined and if this owner has not previous gun law issues, that case against him and the 2nd would be difficult.

The 2nd Amendment doesn't define what an armament is/was.

Why?

The first ban on machine guns happened in the thirties where the incompetent police and the incompetent government or corrupt government was either purposefully or stupidly unable to capture criminals they created by paying attention to the temperance movement.

The government's actions created organized crime at least in the manifestation that it exists today by giving them a income source contraband to smuggle. And ever since they've been doing this over and over and over again.

So to cover up for their stupidity or corruption not sure which not like it makes a difference, they said okay everyone that had nothing to do with this at all you're not allowed to have something because we're too stupid to control the monster we created.

Yeah the government likes to take credit for what private contractors do all the time. They can't provide you with anything because they have no money your neighbor's provided that at exorbitant cost because a bunch of neersowell bureaucrats need to skim off the top.

Thinking the parasites are your friend is part of what parasites do. Municipal utility districts seem to function just fine without having to pay pensions to bureaucrats.
