What Trump said was that using the 25th was that it is.... "unconstitutional powergrabbing"... if he gets to invent the reason.

Investigating a sitting goresident for crimes has happened under practically every administration. I would concede that if every president before Trump has come out as innocent, it's because they are or were pardonned before the investigations got too close...you know, like Nixon. Others I would still have reservations about and believe they are probably guilty, just unproven.

What is more interesting is that both Trump and Dershowitz make serious mistakes in their arguments. Dershowitz invents an interpretation of the 25th accepted by absolutely no one else and Trump unilaterally declares that using an amendment is unconstitutional.

Horrifying.

Yeah, that's ****ing insane and Dershowitz is inventing reasons why an amendment shouldn't be used that don't exist. Projection is a horrible thing when what you wish happened to others is actually happening to you. We are seeing an American president claim that using an amendment on them is unconstitutional because he believes it will circumvent an election. Elections don't grant protection from amendments, guys.

Time to wake up guys.

Well that part is true, as the purpose of the 25th Amendment is NOT to circumvent an election, but rather to establish and validate the succession in the event of the death or incapacitation of the President, fill Vice-Presidential vacancies by the VP's death or incapacitation, and have the VP take over in the event the President is determined unable to discharge the duties of his office. That usually means serious illness, injury, or clear mental incapacity.

It is not set up to allow a "palace coup" of disgruntled officials who don't like the results of an election.

This also sounds right if the sole purpose is to depose an elected official simply because you disagree with his policies, or have a personal animus, and want someone else in the office instead.

Well this seems historically accurate, at least as far back in the 50's - 70's...although it is not that unusual these days either IMO.

The language is "unable to discharge the powers and duties of his office." A president compromised by a hostile foreign power would certainly fall into that bucket.

Yes it seems they are claiming that a candidate can break any laws he wants as long as he wins. How insane is that? The President is our servant and he serves at our pleasure. The Constitution provides many ways to remove a President for good reason. A criminal in that office can do immeasurable damage to the country. Personally I think Trumps's rambling mostly incoherent speech on Friday is a reason enough to consider him a candidate for the 25th amendment. I don't think I am alone in that thought either.

I just laughed at how quickly they all showed up to claim that the president couldn't be removed to circumvent an election - completely ignoring that the only person who has most to gain from stating that it would be done for this reason is the person under investigation.

It's like me saying a specific police officer cant investigate me for murder because I dated and dumped their sister.

Given the amount of things that have been leveled at Trump for the last three years. It would be very understandable to believe, that this action isn't exactly legitimate.

Then again, someone would actually have to address that first. Instead of running from the question.

There aren't enough acrobatic movements in the world for anyone to claim the executive gets to mind read and determine the constitutionality of an amendment's application.
