In the past there has been several instances of bakers and other businesses being sued for not providing their service. The best known case is of course a baker that didnt want to do business with homosexuals, because it violated their Christian belief.

But now that is all changed. In the news, a man was thrown out of Costco because he wasnt wearing a mask. If business have to serve ALL people, yet Costco can refuse that customer, why cant the Baker?

They are discriminating against people that believe wearing a mask is almost totally useless. The best of masks may filter out droplets down to 3 microns. It is a proven fact the China virus measures 1.2 microns, therefore masks really are useless. Costco is discriminating against INFORMED would be customers.

But their (safety) reason is totally flawed. What about the opinion of the would be customer?

Yeah take that number nonsense to a court and see how it works out for you, just be ready to pay their attorney fees, because they will counter your lawsuit with their own. Go for it.

Because the reason the baker refuses to do business with LGBT folks has nothing to do with customer safety. It is irrational discrimination against a group of people for something they can't control.

Second, your comparison of refusing service because of the owners religious beliefs and Costco booting a customer out for refusing to comply with company safety requirements is plain stupid.

There is no Constitutional right to disregard the store’s safety policy.

I cannot violate a store owner's first amendment right by patronizing his store. He can violate my rights if he refuses to serve me based on something that I can't control and in no way affects him. Refusing to do business with someone because of their sexual orientation is no different than refusing to do business with someone based on their skin color. It is equally discriminatory, and any business that does so should lose their business license.

From the Costco incident, it would seem that any store can refuse service for any reason they chose.

Was the store following health guidance on masks from the state or the city? If the governor or mayor declared a health emergency, & ordered wearing face masks & observing social distancing & etc., then the store isn't acting on a whim. If state or local government orders specific steps that the store follows, then it would be hard to argue discrimination by the store on that basis.
