The Power of Clemency and Pardons

We don’t and shouldn’t have kings (or queens). However, one of the holdovers from the British is the Presidential power to grant clemency and pardons. Similarly, many Governors have the same powers. Why? It is ripe for abuse.

It goes on and on.





It’s utterly mind boggling the abuse and yet they have the gall to broadcast political advertisements attempting to frame Harris as soft on crime while a prosecutor and Attorney General. It’s utterly incredulous.

Neither presidents nor governors should have the power of pardon. It’s a mockery of justice.
 
The presidential pardon power should be eradicated. Nothing good results. If Trump wins, he says he will pardon all of these 1-6 domestic terrorists who brutalized 114 cops. That alone should ban him from even running for public office.
 
Executive branch shouldn’t grant pardons and clemency with impunity but then again, the judicial branch shouldn’t be constrained by mandatory or minimum sentencing rules.

Our incarceration rate is an embarrassment. Our racial bias in incarceration is an embarrassment. We need more emphasis on rehabilitation and less on punishment. It’s costly, biased and ineffective wrt recidivism the way it is now.

We could fix that if we had a working government system, alas.

The judicial system is in urgent need of reform. From private prisons and institutionalised racism to politicised DAs and corrupt Supremes, the entire system is broken.

Now, by constitutional convention, the prerogative is exercised by the Sovereign on ministerial advice in the UK.
