Looks like most of the pertinent Constitutional questions go unaddressed. There are, of course, other cases in the pipeline.

Yeah, there are too many cases pending before the lower court, I guess, for a full ruling.

Interesting that the decision was 7-2 on the majority opinion that the commission violated the Mr. Philips first amendment rights.

I still think the final decision, when it comes down, will pivot on a person's right to choose not to enter into a private contract.

I agree. It's a start. And the 7-2 vote is somewhat surprising.

Most law is case law.

They don't have what they need for a full ruling, so they are feeling their way along, trying to slowly build a balance between the competing rights and interests in cases like this.
